Details of SC 8/166/8297
Reference: SC 8/166/8297
Description:
Petitioners: Robert de Thorp, son and heir of John de Thorp.
Name(s): de Thorp, Robert
Addressees: King and council.
Nature of request: Robert, son and heir of John de Thorp states that the manor of Combs in Suffolk is held of the king in chief for an annual fee farm, which fell to the king through the forfeiture of Ralph Avenel, Norman, of whom Bartholomew de Crek, Robert's ancestor, held the manor for the aforesaid farm. After the death of John de Thorp, the escheator, by a writ of diem clausit extremum, at the suit of Alice, John's widow, seized and held the manor until Robert, through ignorance, did homage to the king - and he then had his seisin. The escheator has levied and taken the issues in the meantime, and he is also distrained by the sheriff of Suffolk for relief. Robert has sued to chancery for a remedy, until now at Pentecost, when the chancellor has adjourned him to parliament. He requests a remedy if law or reason demands it, quoting two points of Magna Carta in support of his case, and attaching copies of a certification of the exchequer, the writ of diem clausit extremum and the subsequent inquisition.
Nature of endorsement: It should follow in Chancery the response otherwise thus made before the King.
Places mentioned: Combs, Suffolk; Norfolk.
People mentioned: John de Thorp; Ralph Avenel; Bartholomew de Crek; Alice [de Thorp], wife of John de Thorp; sheriff of Norfolk and Suffolk.
Note: Dated on the guard to 1325, with reference to SC 8/8/355, SC 8/8/356A, and SC 8/8/356B, earlier copies of this petition and its two enclosures, dated to 1324 by PROME although internal evidence shows that it is from 1325.
