| John, Bishop of Lincoln, and the Dean and Chapter of Lincoln, state that they, and certain prebendaries of the chapter, have from time immemorial been seised of certain lands, tenements, rents and possessions in the city of Lincoln, of which they have recently been disseised by people of the city, who then conspire to use the franchise of the city, which provides for these wrongs to be tried by inquest of the city, to deny them justice, and also to sue for trespass any of their ministers attempting to collect their rents by distraint. They request that in any such plea or assize in the city of Lincoln, to which they are a party, the inquest or jury should be of outsiders, and also that it might be possible to remove such a plea or assize to the king's court; and they further request justice. |
| A writ, containing the tenor of this petition, is to be sent to the Mayor and bailiffs of the city of Lincoln, to appear before the king and his council at Westminster in this present parliament on the Tuesday after Candlemas next, with sufficient instruction and information concerning all the matters contained in this petition, and with sufficient power and authority under the common seal of the city to answer for themselves and the community of the city concerning everything contained in the petition, and to discuss and come to a final decision on these things, and to do and receive what the king and his council ordains in this matter, on pain of £200.On that day, because the Mayor and bailiffs did not bring a sufficient guarantee, as they had been told, they were placed in contempt. And it was agreed and established by statute that in assizes, juries and all other inquests to be held before the Mayor and bailiffs of the said city for the time being, if one of the parties complains of conspiracy by that assize, jury, or inquest, the attaint is to be granted, and the record sent by writ to King's Bench or Common Pleas; and the sheriff is to array the jury of the attaint of outsiders, and the justices to take the jury of the same outsiders, notwithstanding the franchise of the city, or any other usage to the contrary. |
