Reference: SC 8/162/8069
Description:
Petitioners: John Hoton.
Name(s): Hoton, John
Addressees: Council.
Nature of request: [The petition is badly damaged and largely illegible].Hoton requests a writ to the commissioners to proceed to the conclusion in the plea that has been long pending and delayed in the court of chivalry between him and Shakill, and afterwards Shakill's executors.
Nature of endorsement: . . . to proceed in the plea, and do justice to the parties, notwithstanding any writ to the contrary.
Places mentioned: Westminster.
People mentioned: John Shakill (Shakell); John Wroth, knight.
Note: A commission and special mandate was issued to hear and determine the appeal of the defendant in this case on 4 October 1393 (CPR 1391-6, p. 318) But John Shakill was still alive at this point: later commissions and mandates were issued after his death (CPR 1396-9 p.58 and p.83, both dated 9 December 1396, and p.165, dated 1 July 1397). This petition is therefore tentatively dated to c. 1396. See also SC 8/341/16083.
