To: The General Board of Health.

From: George Bailey, Clerk to the Luton Local Board, Luton [Bedfordshire].

Subject Matter: Letter enquiring as to a 'fieldway' which has never been repaired by the parish and leads to common field lands, and which was partially built on with cottages, and a new street opened through private land into this fieldway, but neither repaired by the parish, although the public have had free passage through them for 19 years. Bailey explains that the Luton Local Board recently served notice under section 107 of the Public Health Act 1848 for the proprietors to sewer, channel and pave etc., these streets, but that the proprietor claims that the Board does not have powers under section 69 of the Act, and he therefore raises certain questions as to the legality of the proceedings on this matter.
