Details of SC 8/39/1926
Reference: SC 8/39/1926
Description:
Petitioners: Margaret de Clare.
Name(s): de Clare, Margaret
Addressees: Earl of Cornwall.
Nature of request: 1) Clare shows that she holds the manor of Kenton by gift of the king, the manor lying within the earl's fee, and in which no bailiff should enter except through the earl's bailiffs. Pyrigge entered the liberty to make distraints and attachments but he was resisted by the earl's bailiffs and men. Because of this the sheriff of Devon came under a commission of the king and arrested and imprisoned many of the people of the manor and would not allow them to be mainprised to their great damage. She requests remedy so that the people of the manor are in no way distrained and the estate of the manor be maintained.2) Also she shows that the mayor and bailiffs of Exeter distrain all the earl's bondsmen when they come to Exeter to buy and sell for all manners of customs which were never before demanded or paid to the earl's disinheritance, and the damage of Clare. She requests that the earl will demand that the mayor and bailiffs will cease such distraints.
Nature of endorsement: [None]
Places mentioned: Kenton, [Devon]; Exeter, [Devon].
People mentioned: [Piers de Gaveston], Earl of Cornwall; William de Pyrigge, Bailiiff; William Martin; Thomas de Ralegh (Raleigh).
Note: The petition can be dated to 1308 for the people of Kenton were pardoned for rescuing distraints on 4 April 1308 (CPR 1307-13, p.63). The petition would have to date to this time anyway, for Piers Gaveston only became earl in 1307, and Clare married Gaveston in 1309.
