The Prisons and Probation Ombudsman for England and Wales was first appointed in September 2001 following the setting up of the National Probation Service. The Ombudsman investigates complaints from prisoners, people on probation and immigration detainees held at immigration removal centres; and deaths of prisoners, residents of probation service Approved Premises, and those held in immigration removal centres.

The Ombudsman is appointed by the Secretary of State for Justice and is completely independent of the Prison Service, the National Probation Service and the Border and Immigration Agency. The Ombudsman's office is now sponsored by the Ministry of Justice (MoJ) having previously been the responsibility of the Home Office.
