Description:
Content: Folio 18. Draft letter from the Poor Law Commission to Thomas Canning regarding the case of the wife of a man in his service who had been refused relief for her illegitimate child. The father of the child had paid £25 to the parish but, following her marriage, the board of guardians had told her that her husband must now support the child. The letter states that, under Section 57 of the Poor Law Act, responsibility for the support of the illegitimate child falls to the husband. It also points out that the mother has no legal claim to the money paid by the father of the child as the courts had decided that such payments were illegal (citing the case of Cole v Gower, 6 East 110). It suggests that the child's father may take legal action against the parish to recover any of the money remaining unspent. Paper Number: 1476/A/1838. Poor Law Union Number 167. Counties: Hertfordshire and Essex.
