Content: Folio 35. Letter from Thomas Day, Clerk to the Guardians of Bromsgrove Poor Law Union, to the Poor Law Commission. The guardians regret that it should be required under an order of the Commission dated 6 February 1841 that the votes of the ratepayers should be taken and the parish put to the expense of a contested election in case more persons are nominated for the office of guardian than are to be elected. Instead they could be reduced to the proper number by the consent of the nominator and the declaration of the person nominated of his unwillingness to execute the office. Last year the those parishes where the number of nominees exceeded the number of posts, the number was reduced in this manner but in compliance with the election order the whole number were put to the vote. Only two votes were recorded for persons unwilling to act. Annotated: with a draft reply that the Commission have always recognised the importance of the power to receive the resignation of candidates but that the right to elect candidates is that of the whole constituency. If such withdrawal were allowed, the greatest opportunity would be afforded for fraud. Paper Number: 1809/B/1841. Poor Law Union Number 526.
