Description:

The document recites, firstly, (a) an indenture (dated 4th July, 1898, whereby William Iliffe (then formerly of Coventry, gent.) by his will (dated 30th Nov, 1882) appointed his [second] wife, Jane, his son, William Isaac Iliffe (of Coventry, printer and publisher), and James Thomas Moy (of Coventry, grocer) his executrix and executors, and devised premises in Barras Green, Stoke (acquired from his wife before marriage) to his executors as trustees on lease for ten years with power of sale at the end of that term or at his wife's death, whichever happened sooner; (b) a codicil to W. Iliffe's will (dated 8th Mar, 1886) irrelevant to this property; (c) the fact of W. Iliffe's death on 23rd Oct, 1890 and the proving of his will on 21st Mar, 1891; (d) J. Iliffe's death on 27th Apr, 1898; therefore by the reciting deed, in consideration of £385, W. I. Iliffe and J. T. Moy conveyed to Henry James Harborn (of 12, Sparkbrook St., Coventry, licensed victualler) (1) land (formerly of three plots) in Barras Green, Stoke, Warws. (with a 106 ft. 3 in. frontage to Coventry St.) measuring 2,212 sq. yds. (bounded on the north-west by that street; on the north-east by property once belonging to William Thompson, subsequently to Jabez Walter, then to Mrs. Ward; on the south-east partly by hereditaments then recently sold by W. I. Iliffe and J. T. Moy to Henry Harvey, but also by the lands of Caleb Wakefield; and on the south-west by premises formerly William Dry's but then Mrs. Clarke's); (2) land (formerly of five plots) in Avon St. with frontage to that street of 189 ft. 6 in. measuring 4,175 sq. yds. (bounded on the north-west by that street, on the north-east by [premises described in 333/7], on the south-east by Frederick Pridmore's hereditaments; on the south-west by lands once Henry Masters' but then J. Elsworth's) with building-covenants in both cases as in 333/1; this 1898 indenture closes with a schedule of six deeds (dated 25th June, 1869 to 3rd July, 1876) and there is a copy of a plan sharing the Coventry and Avon Sts. properties; the abstract recites, secondly, H. J.Harborne's will (dated 27th Jan, 1908) wherein the testator, a retired licensed victualler living at Harborne House, Coventry St., Stoke, Coventry appoints his friends Herbert Johnson (of Coventry, solicitor) and Joseph Allen (of Waterloo Tavern, 41, Brook St., Coventry, licensed victualler) trustees (to sell the estate) and executors; thirdly, that H. J. Harborne's codicil of 29th Jan, 1908 is irrelevant to these premises; fourthly, that H. J. Harborne died on 1st Mar, 1908; fifthly, that H. J. Harborne's will was proved on 29th May, 1908; sixthly, that the Avon St. hereditaments were (by an indenture dated 24th June, 1908) conveyed by Harborne's executors to John Taylor (of Coventry, machinist) in consideration of £300 and subject to the 1898 deed's covenants; seventhly, by his will (dated 21st May, 1890) J. Taylor (of 5, Britannia Terrace, Far Gosford St., Coventry, machinist) appointed his wife Emily Jane executrix and devisee of all his personalty, which by default was to be equally divided amongst his children; eighthly, that J. Taylor died on 21st Feb, 1918; ninthly that J. Taylor's will was proved on 29th Apr, 1918; tenthly that a certificate in discharge of J. Taylor's estate duty was issued on 7th June, 1918; eleventhly, that by an indenture (dated 21st Aug, 1920) E. J. Taylor (of Washington Cottage, Avon St., Upper Stoke, Coventry, widow) conveyed to Hugh Airlie (of 25, Victoria Terrace, Wren St., Coventry, Admiralty inspector) the premises in Avon St. described in the 1898 deed, plus "Washington Cottage"; twelfthly, that by an indenture (dated 23rd Aug, 1920) in consideration of £1,300 with a redemption-rate of £5% p.a. payable on 5th Jan, [1921] (reduced to £4/10/-% p.a. if repayment was prompt) H. Airlie (described as in the eleventh recital) mortgaged to Thomas Frederic Higys (of Dudley, Worcs., M.D.), Walter Jones (of Stourbridge, Worcs., ironfounder) and Leonard Foster (of Upper Gornal, parish of Sedgeley, Staffs., maltster), as trustees of the Midland Counties Mutual Benefit Society, the premises enumerated on a schedule contained therein, with repair-covenants, and the option of repayment on any quarter day of sums up to £10 and a maximum of £50 with three calendar months' notice.
