Description:

Petition and Appeal of Charles, L. Mohun, executor of Charles, E. Macclesfield, deceased, who was executor of Lady Elizabeth Gerard, deceased, the widow of Digby, L. Gerard, deceased. By articles made on 15 July 1698 between the Respondents, D. Hamilton and Elizabeth, his wife, the daughter of Digby, L. Gerard, and Lady Elizabeth Gerard, his wife, on the one part, and the said Lady Elizabeth Gerard, mother and guardian of the said Respondent Elizabeth, of the other part, it was agreed that in consideration of a marriage between Respondents and to prevent all future demands on Lady Elizabeth Gerard, the mother, the Duke should release to her all actions, etc., by reason of her being guardian to her daughter, and oblige himself to her in the sum of £10,000 for that purpose.

a) 12 Jan 1703-4 -- Petition of Respondents for further time to answer, as the Duke is in Scotland and unable to consult with Counsel owing to a violent fit of the gout. Lords Journals, XVII. 363.

 

b) 26 Jan -- Answer of James, D. Hamilton and Elizabeth, his wife.

 

c) 1 Feb -- Petition of Respondents.
