(2) Josias Morley of Giggleswick, co. Yorks., esq., brother of (1)

 

Assignment by (1) to (2) of all her right title and interest in legacy of £250 bequeathed by Thomas Benison to her and appointment of (2) as her lawful attorney; reciting (i) will, 6 Dec. 1723, of Thomas Benison of Lancaster deceased, grandfather of (1) and (2) devising to Josias Morley the interest on £500 during the life of his uncle Josias Morley then of Scale Hall, co. Yorks., gent. and after death of latter the £500 to go to his granddaughters Elizabeth and Margaret Morley and appointing Thomas Benison (junior) his executor; (ii) deaths of Thomas Benison the testator and Josias Morley, senior, and the vesting of the £500 in Elizabeth and Margaret Morley; (iii) that the legacy remained in the hands of Thomas Benison the executor during his lifetime; (iv) death of Thomas Benison, the executor, intestate and the subsequent administration of his goods by Ann Winder Benison, his widow; (v) that £250 is now due to (1); (vi) that a marriage is proposed between (1) and Caleb Readshaw of Richmond, co. Yorks., gent. and that the £250 is required towards the marriage portion; (vii) that Ann Winder Benison is not able to pay it and that (1) has prevailed upon (2) to advance the £250 in return for which she proposes to assign her share of Thomas Benison's legacy to him
