Manors of Stoulton cum Wadborough and other lands in co. Worcs.

 

Recites that the premises were conveyed by (a) to Sir John Trevor, Richard Winwood, and Walter James, dec'd. to sell the same and meanwhile employ the profits subject to trusts declared in indentures of 30 June 1634 and 14 July 1635. At the sealing of the latter deed the sum of £3,000 was due to Sir John Trevor, which he had delivered to Sir Edward Fitton, and £500 which he paid on 10 July 1635 to Thomas Minshull, esq., as part of the portion of w. Jane, due from bro. Sir Edward Fitton. The £3,000 was rated at 8 per cent. from 1 April 1635 and the £500 at 8 per cent. from 10 July 1635. These sums were to be retained by Sir John out of the money for the sale of the premises. Sir John also paid £500 on 27 Oct. 1635 and £500 on 28 June 1636 in full of the portion of Lettice, w. of John Cole, due from bro. Sir Edward Fitton. Sir John paid £500, the remainder of the portion, to Thomas Minshull on 8 April, 1636. Richard Winwood never received any profits and Sir John received only £330 from the premises since 14 July 1635.

 

The premises were sold to Samuel Sandys, esq., for £7,300, of which £6,300 was due to Sir John and Sir Edward has consented to allow till 21 November 1637 for payment of the residue of £1,000. Samuel Sandys has entered into a recognizance in the nature of a Statute Staple in £2,000 with Sir John for payment. The sum of £1,025 only remains in Sir John's hands out of the profits of the premises.

 

(a) now give a discharge to (b) for all sums saving only the £1,025 and the money due on the statute staple, subject to trusts as in the deed of 14 July 1635.
