Plaintiffs by their attorney Francis Gerard say that Margaret and Jane claim the premises under a deed of gift of Richard Cleche, Thomas Carpenter and John Pounsar to John Barfote and Agnes his wife, remainder in fee tail to the heirs of Agnes's body, remainder to Henry, Robert and Alice, children of John Wilcox successively, remainder to Margaret and Jane, daughters of Thomas Aldworth, son and heir of the said Alice. All persons in remainder had died except the two last, now plaintiffs.

 

Defendants by their attorney John Puckle plead imparlance which is granted to the morrow of Trinity and then to the octave of Michaelmas, and say that Robert Wilcox did not die without heirs; that Margaret and Jane are not the daughters and heirs of the said Thomas Aldworth; and that the gift was not in the narrated form.

 

A note on the reverse of fo. 6 states that the defendants claim thus: Aldworth being seised, devised the premises to Alice Pyle, daughter of his daughter Alice Aldworth, and the heirs of her body. Alice Pyle the granddaughter married one Atwater, who had a son and daughter named Alice. Atwaters son had a daughter who died without issue, whereupon the premises came to Joan Randall, daughter of Atwater's daughter Alice. This Joan married the defendant.

 

Endorsed: 'Rastell title formedon fol. 340.' and in a 19 cent. hand 'Writ of Formedon.'
