The capital messuage in the town of Derby in Cock pit hill, in the occupation of Mrs. Chambers, cottage in Bag Lane, Derby, in the occupation of William Needham, inclosed pasture of 2 acres called Cockpit Hill Orchard, inclosed pasture of 4 acres in Derby divided into 3 closes.

2. The messuage in Millington known as Peacocks with 2 closes called the Nearer and Further acre purchased of Joseph Clare and John Peacock, the messuage late in the possession of William Ashley and the closes belonging known as Barn Meadow, Sandfield, Bigfield, Gorsenfield, Crabtreefield and Churchfield of 11¾ acres 36 perches of Cheshire measure purchased of William Willetts, clerk, and George Jackson, gent, in Millington.

3. Cottage in Rostherne near to Bucklow Hill called Bradburn's tenement and its croft called Burn Croft of ½ acre in which it stands adjoining to a lane leading from Bucklow Hill to Rostherne Church bought from Robert Taylor, gent. and Massie Taylor, esq.

4. A term of 500 years which in 1740 was limited to Thomas Rolleston and George Chaworth.

Conditions of uses: until the marriage, to their present uses, after that, discharged from finding the £300, to the use and purpose that Jane Hayford the mother has £150 for life, then to William Welby and William Chambers for a term of 999 years, after that, and with the Derby property, to Brownlow Cust, bart. and Job Staunton Charlton, to the use of John Thorold and Jane Hayford for life, and to the trustees on the death of either for the use of the survivor, to preserve the contingent remainders, then to the use of the younger children of the marriage, if none to the use of Jane Hayford's will and to the heirs of Jane Hayford and for default, as to the manor of Millington to John Thorold his heirs and assigns, as for the Derby property, to the survivor of Jane Hayford the mother or daughter and her heirs.

The term of William Welby and William Chambers is for securing the £150 for the mother Jane Hayford, to permit Brownlow Cust and Job Staunton Charlton to take timber for repairs of buildings and for John Thorold to take timber.

The estate of Brownlow Cust and Job Staunton Charlton for the joint life of John Thorold and Jane Hayford is to be for the sole use of Jane Hayford, and trustees can make leases, power even to sell and buy other lands with the consent of John Thorold and Jane Hayford, mother and daughter.
