Settlement on intended marriage of John Mytton and Sarah Harriet Owen

Sarah Harriet Owen is entitled to a portion of £1000

 

Consideration: mortgage and portion

To use of John Mytton and heirs until the marriage, after to use of Mytton and assigns for life, trustees to preserve, after to use that Sarah may receive, if she survive John, an annual rent charge of £500 for life, clear, with power to distrain after 30 days; after to use of Dod and Owen for term of 100 years; to use of Probert and Edwards for term of 500 years; after to use of sons in tail male; after to use of Corbet and Kynaston for term of 600 years; remainder to use of John Mytton his heirs and assigns

 

The term of 100 years is to secure payment of the £500 the term of 500 years is in trust, if Sarah survive John, to raise by mortgage or sale £500 for her and portions for younger children - if one, £6000; if 2, £8000; if 3 or more £10,000; the money to be divided as John Mytton shall appoint, payable at age 21 or 6 months after the death of the father; the portion of any child dying or becoming an eldest son to be vested in the survivors but not to increase their portions beyond the sums laid down before for 1 or 2. Money to be raised for education and maintenance of the children at rate of 3% on the portions till they are 15 and 4% afterwards till 21

 

Mytton may appoint portions during his lifetime and advance money for them, but this is to be deducted unless he declare to the contrary. No money to be raised before it is payable. Residue of rents to be paid to the person entitled expectant on the determination of the term.

 

If Sarah survive John, his executors shall raise £500 and pay it to her for her use within 1 months of his death

 

The term of 500 years is on trust if there is no son, to raise £2000 for additional portions of daughters, but no daughter to have more that £8000 portion altogether nor two daughters more that £10,000 between them.

 

Powers to lease and exchange

 

If the marriage take effect, Mytton will assign to Edward Henry Owen and Rebecca Owen the younger, Maria Owen, Sobiesky Owen, Eloisa Owen and Laura Owen or the survivors as tenants in common for their use all such sums of money, other than the £1000, to which he shall be entitled in right of his wife under the settlement made on the marriage of William Owen (deceased) and Rebecca and the indenture of 10 January 1792
