Description:

Examination of John Davy of Cuby, formerly of Luxulyan and Peter Cripps concerning the watercourse claimed by Lord Radnor's Agents for Snea Mill:

John Davy held Snea mill 'above 60 years since'; mill was worked with Helman Tor Water 'otherwise Lanlivery Water which was not enough to work the mill in summer time by which means it stood idle and was only called a Cuckow mill; about 30 years Michael Bridgman 'now of Millbrook' took the mill 'and he supply it with more water took up the water of Saddle back moore out of the Tinners Tye belonging to Richard Edgcumbe, esq. to assist this mill; Noah Nanjulyan father-in-law of John Davy told Michael B. he had no right to take up Saddleback water; Peter Cripps of Lanivet said he worked several years ago in a streamwork in Sadleback moor, he needed water for his work and rented Lanlivery water from Lord Robartes' agents; 'That Snee mill being hereby deprived of water to work it, the then Miller to supply his mill stopt the Tinners Tye and from thence conveyed Sadleback water and Lanlivery Water from the Tye to drive his mill.'

When this happened Robert Hawken, John Tom and Richard Scantlebury in presence of Peter Cripps and John Thomas of Lanivet 'cut down the said Dam of the miller in the Tinner's tye to justify Mr. Edgcumb's right and interest in the Water belonging to Saddle back and that none of it ought to goe to Snee mill. The Millers pretence then was that as Lanlivery water was applyed to work that work and his mill wanting water to drive it made the Dam in the Tye to carry it to his mill'
