BUILDING CONTROL AND PLANNING APPLICATION PLANS: RESTRICTIONS ON COPYING

 

The plans were deposited with Norwich City Council for building control and planning purposes only and neither the Council nor the Record Office is authorised to supply copies of the plans. Most were drawn by architects or by other private companies or individuals who retained the copyright. The City Council also has an obligation to protect the safety and privacy of the current owners of buildings.

 

Before a copy can be supplied of any plans in the building control series the person requesting it needs to satisfy either the Record Office or the City Engineer's (or Planning) Department of Norwich City Council of the following:

 

1) Copying will not infringe a third party's copyright, either because copyright has expired or because the copyright owner has agreed to a copy being supplied.

 

Copyright in 'artistic works' (including plans and architectural drawings) expires 70 years after the end of the calendar year of the author's death, the author normally being the person who drew the plans, unless he or she was working as an employee of a company, or under a contract which specified otherwise. Evidence would be needed that the architect or other originator had died (or ceased to exist) more than 70 years ago or a letter of permission produced from the originator or his or her successors.

 

2) The current owner of the property agrees to the supply of a copy. A written statement, signed by the owner (who may also be the person applying for the copy) will suffice as evidence of this.

 

In cases of doubt the Record Office will consult the City Engineer's Department for advice. If any of the above criteria cannot be clearly met a copy cannot be supplied.
