9 February 1641 -- Petition of Arthur O'Keife; has been a captain beyond seas, and done His Majesty good service in the wars; has long been in prison, and now merely for fees amounting to £4 10s; his wife and children are in great distress; prays for a comfortable gift towards his releasement.

 

9 February 1641 -- Petition of inhabitants of Great Walldingfield, Suffolk; for consideration of articles of grievance against their minister, Andrew Sandiland, a Scotchman.

9 February 1641 -- Copy of petition of Nicholas Bloxam, clerk, for restoration to the living of Great Walldingfield, Suffolk, from which he has been expelled on a charge of simony by Andrew Sandiland.

 

9 February 1641 -- Petition of John Swaddell, and other inhabitants of Wootton, in the county of Somerset; Wootton is a hamlet, with a chapel-of-ease, about a mile from the parish church of Pilton, and by a very ancient composition of one mark, the vicar of Pilton is bound to perform service there on Sundays; about eight years ago the present vicar, Mr Nathaniel Abbott, procured a sentence " in the court of the now Chauntor," and on appeal in the Arches Court denying the service, except on payment of certain rates; pray for redress.

 

9 February 1641 -- Petition of Tobie Pallavicine against Sir Francis Clarke, Knight, and others, touching a mortgage of two leases of the manor of Foxton, in the county of Cambridge.

9 February 1641 -- Petition of William Palmer: for reversal of a decree in Chancery in a suit brought against him by Martha Gray (now in HL/PO/JO/10/4).

1 Petition of same; has been arrested and imprisoned in the Fleet: prays that his petition may be read, and that he may have the protection of the House whilst prosecuting his suit.

 

9 February 1641 -- Petition of John Watkins, B.D.: Henry Morgan, clerk, was lately presented to the rectory of St Fagan's; but a charge of simony was brought against him, and petitioner obtained presentation from the King. Morgan is dead; but the Bishop of Llandaff will not institute petitioner upon the King's title: prays for relief.

 

9 February 1641 -- Petition of Richard Weoley, parish clerk of St Botolph, Without Bishopsgate, London: his wife Mary by petition to the House has obtained the reference of her case to Dr Duck, who, besides £14 per annum and a house, formerly settled for her maintenance by Sir John Lambe, has urged petitioner to give her £6 per annum more, and £5 toward payment of her debts; petitioner is quite unable to do this, and it is through his wife's unbridled carriage, that he is in debt himself: prays that she may be ordered to return to his house, or to be satisfied with £14 per annum and a lodging.

9 February 1641 -- Petition of Margaret Frith, relict of James Frith, deceased, and of Richard Weston, guardian to Humphrey and Ann Alcock, orphan children of Richard Alcock. Frith, a surgeon in the East India Company's service, was killed by the Moors at the factory at Iambe. Alcock, also a surgeon in the Company's service died at the River Armagan: petitioners pray for payment of certain sums, which they allege to be due from the company to the estates of Frith and Alcock respectively.

9 February 1641 -- Petition of Andrew Badger, a poor prisoner in the Fleet. Thomas Sallowes surreptitiously obtained a verdict against him in the court of King's Bench, upon which he was taken in execution and cast into prison: prays for his discharge. Noted, with order for the Lord Chief Justice of the King's Bench to certify how the cause stands in that court.

9 February 1641 -- Petition of Mathew Brownrigg of Clopton, in the county of Suffolk, clerk. Robert Brownrigg was possessed of estates in Suffolk, and at his death the wardship of his only child Elizabeth, was committed to her mother, who afterwards married Mathew Wren, now Bishop of Ely, the bishop obtained license from the King on false grounds for the ward Elizabeth to suffer a common recovery for raising money, and has thereby sold away much of her estate and settled the rest failing issue of her body on his own children, to the disinheritance of petitioner, the heir-at-law: prays that the recovery may be vacated.

 

9 February 1641 -- Petition of inhabitants of Chipping Campden, in the county of Gloucester: about 154 years ago, one John Darbie gave to the free school and poor of the parish the manor of Fines Court, in the county of Oxford, the profits of which were received by the churchwardens of Chipping Campden for many years, until by the fraudulent conduct of Sir James Mervin, Sir John Walter, and others, the inhabitants have been almost entirely deprived of the profits of the said lands: pray for redress.

 

10 February 1641 -- Petition of Richard Wright, for relief against his father, who has married his daughter's maid, and cheated petitioner out of certain property due to him in reversion.

 

10 February 1641 -- Petition of Dame Elizabeth Slingsby. Petitioner and her late husband Sir William Slingsby had one daughter Elizabeth, who was without their knowledge married to Chichester, son of Sir Faithful Fortescue: the marriage was kept secret until after Sir William's death who left his daughter £2,000 Sir Faithful entered into an agreement to settle a jointure on his daughter-in-law, but has made secret conveyances by which he avoids carrying out the agreement: he and his son, who has left his wife and child with petitioner, are in Ireland, and therefore cannot be reached by legal proceedings in England: prays that Sir Faithful Fortescue may be ordered to show how his estate stands, and to execute his agreement, or at least that the £2,000 may be secured.

10 February 1641 -- Petition of Marcus Brand, that one Nevill may be ordered to discover the residence of his brother-in-law Hamfreville, for whose apprehension a warrant has been issued by the House, on a charge of counterfeiting a protection from the Earl of Castlehaven [Lord Audley].

5 Petition of Caesar Calandrine, clerk and prebendary of the prebend of Hatherton, in the parish church collegiate of Wolverhampton, to be restored to the possession of the profits of the said prebend, and for satisfaction for the expense he has incurred.

10 February 1641 -- Petition of Gilbert Wells against Thomas Westropp, who has already been, convicted in the Star Chamber of cheating petitioner with false dice, and is now attempting, by petitioning: the House, to avoid trial at Winchester assizes: prays that Westropp may be ordered to give security to appear.

 

10 February 1641 -- Answers of Sir John Brampston, Lord Chief-Justice of the King's Bench, to the interrogatories put to him in the case of the Lord Keeper Finch.

10 February 1641 -- Petition of Antony Sterling and Margaret Borrett, complain of a sentence in the Star Chamber in a suit long abated but revived by one Folks, clerk, who has thereby paused Sterling to be imprisoned, and has expelled his wife and children from their home with great violence.

 

10 February 1640-1941 -- Petition Of John Gell for hearing of his case against the Lord Chaworth, touching a lease of the manors of Werton [Warton] and Tythby.

 

10 February 1641 -- Petition of James Crichton, a native of Scotland; came to England in 1633 hoping to obtain recovery of certain lands from his uncle, James Steward; in 1638 was committed prisoner by the Lords of the Council upon the information of the Attorney-General, though no charge was specified, and again, in 1640, was imprisoned in Newgate as a traitor, his papers being seized and searched, but no charge brought against him, except that he was a Scotchman: prays for redress.

 

10 February 1641 -- Draft order appointing the hearing of the cause of John Hassell against William Nevill, Mary Reynolds, and John Page.

 

10 February 1641 -- Petition of Richard Reynolds, clerk, prays to be restored to the parsonage of Oddington, Oxon. In 1635 the late Bishop of Oxford declined to institute petitioner in consequence of a letter received from the late Lord Keeper. Coventry, and litigation has been going on ever since.

 

11 February 1641 -- Petition of Sir John Lambe, Knight, and Arthur Ducke, Doctor of Laws, are sentenced to pay damages to Mary Wheeler for setting their hands to a warrant or attachment of the High Commission Court; they have never been heard, and therefore pray that the sentence may be respited.

 

11 February 1641 -- Copy of proposition of the Scots about their seventh demand, viz., that the declaration made against them as traitors might be recalled.

1 Petition of Sir James Hay and Archibald Hay. The late Earl of Carlisle being seized in fee by grant from His Majesty of the Caribbee Islands and of the government thereof, conveyed the same to petitioners in trust for payment of his debts; they are molested in the management of the islands by the present Earl, who denies their right to the government, without which the trust would be useless: pray for a decision on this point.

 

2 Petition of William Latham and others, creditors of the late Earl of Carlisle: are checked from proceeding at law for recovery of their debts, by an order, of the Court of Wards at the suit of the present Earl of Carlisle, who also interferes in the government of the Caribee Islands. Pray for redress.

 

12 February 1641 -- Petition of John Weld, servant to the Earl of Nottingham, complains of his arrest at the suit of one Forest, contrary to privilege.

 

12 February 1641 -- Petition of Elizabeth Clarke, widow. Petitioner's husband, Captain Peter Clarke, was murdered by Lewis Kirke, Henry Lord Morley, and one Johnson; but the grand jury, who found Kirke guilty, found an ignoramus against Lord Morley, who really gave Clarke his death wound. Prays for consideration of the charge against his Lordship.

1 Petition of same that the hearing of her case may be deferred on account of the difficulty of finding her witnesses.

 

2 Francis Littleton to Lord Morley. Has heard of a plot against his life and honour, the prosecutor of which is Mrs Clarke; will meet his Lordship, if he please, this afternoon in Gray's Inn Walks, to acquaint him therewith.

 

12 February 1641 -- Draft order for production of the bond for 100,000 marks, mentioned in the case between Sir Filibert Vernatti and Mr Latch.

12 February 1641 -- Draft order for Henry Twentyman, and others, to give security for their appearance at the suit of John Batty.

 

13 February 1641 -- Petition of the Earl of Strafford, for a longer time to put in his answer.

 

13 February 1641 -- The examination of Sir Foulke Hounckes in the Earl of Strafford's case.

 

15 February 1641 -- Petition of the Honourable Wm. Arundell and the Eight Hon. Mary Lady St. John, his wife; are indicted for recusancy in the county of Wilts; pray for removal of the trial to the Court of King's Bench by certiorari, on account of the infirmity of Wm. Arundell, and because they have important suits pending in London.

 

15 February 1641 -- List those who have visited Sir George Radcliffe from the 6th to the 13th instant.

 

15 February 1641 -- Draft order that Geo. Fisher, Edwd. Salisbury, and John Davidge, churchwardens of St. Ethelborough, shall remain in custody till they have performed their Lordships former order.

 

15 February 1641 -- Petition of William Latham and others, creditors of the late Earl of Carlisle. It has recently been discovered that certain lands in Ireland, which should have been available for payment of the Earl's debts, have been sold to the Earl of Stratford for £15,000; they pray that the said lands may be made chargeable for payment of their claims.

 

16 February 1641 -- Petition of William Speringe. Petitioner gave 40s. to one Benbrigg for a protection, stated to be under the hand and seal of Lord Fauconbridge; and 40s. more for a renewal of the same. Benbrigg is now in the Fleet for forging the said protections. Prays that before his discharge he may be ordered to repay the £4 paid by petitioner.

 

16 February 1641 -- Petition of the Earl of Strafford for fourteen days further time to put in his answer.

 

16 February 1641 -- Draft order for Sir Richard Skeffington, Knight, and others, to answer the petition of Symon Rugeley.

 

17 February 1641 -- Petition of Edward Bagshaw and others, children of Thomas Bagshaw, deceased. Edward Bagshaw was brought up as a Romish recusant for twenty-eight years, but being sick desired to go to the Church; he was, however, kept close prisoner by his father and afterwards by his younger brother Thomas, to whom, in hope of obtaining his liberty, he made a conveyance of his estate; he finally managed to escape, but was arrested for debt by the under-sheriff of Derbyshire, and again forced to enter into agreement with his brother Thomas, who keeps him and his brothers and sisters out of their portions. Prays for redress.

 

17 February 1641 -- Petition of Thomas Williams [to the House of Commons], prays for relief against John Vaughan, a solicitor, who, having arrested petitioner for £13, caused him to be again arrested for the same money after payment made.

 

17 February 1641 -- Petition of Humphrey Leigh, sergeant-at-arms. Has ever attended the Lord Keeper to the House and been employed to bring delinquents to the bar, carry them to prison, etc.; but Mr. Maxwell, Gentleman usher of the Black Rod, has lately upon some pretence obtained an order that he and his deputies only shall perform these duties. Prays to be heard by counsel in favour of his claim.

 

17 February 1641 -- Petition of Robert Sharpe [to the House of Commons]. A commission was appointed some years ago to enquire into the question of fees in the ecclesiastical and temporal courts; great benefit was derived from this commission until one John Dibley, clerk to the Commissioners, by taking bribes from the persons questioned, brought the commission into disrepute; many delinquents have since obtained letters patent authorising their exactions. Prays for consideration of the matter.

17 February 1641 -- Petition of John Archer, of South-wark, haberdasher; against Robert Keene, of Kingston, clerk, and his daughter Elizabeth, against whom petitioner has proceeded in the Arches and High Commission Courts for breach of promise of marriage; has obtained a sentence in his favour, for not performing which the said Robert and Elizabeth Keene are excommunicated. Prays for further redress.
