Recites that the heredits. plus Pixley and Losford Hall farms were limited under the will of Sir Corbet Corbet to trustees upon trust to pay certain life annuities and as to the Manor of Adderley to execute deeds to give effect for the charges and provisions for Eleanor Corbet and the daus. and younger sons of Richard and Eleanor Corbet created by Settlement of 1 March 1830 and subject to the trusts in trust for Richard Corbet during his life and after his d. in trust for Henry Reginald Corbet the eldest son of Richard Corbet.

 

Recites that under will of Sir Corbet Corbet Richard Corbet was not to come into possession of the rents etc. of the estates devised to him by the said will until satisfaction of the trusts for payment out of the rents.

 

Recites that Richard Corbet to accelerate the discharge of the incumbrances and mortgages incurred debts of £32,000.

 

Recites marriage settlement of Richard Corbet and Eleanor Corbet then Eleanor Johnson dated 1 March 1830 in which a rentcharge of £500 was assigned to Eleanor Corbet out of the manor of Adderley and other premises in Adderley after the d. of Richard Corbet for her life in lieu of dower and the premises were assigned for term of 200 yrs. to John Whitehall Dodd, George Johnson and Henry Bloxam upon trust to pay the said rentcharge of £500 and the premises also charged with £500 for the portion of the younger sons and the daus. of the marriage for which purpose the premises should be demised to Mascie Domville Taylor and John Bellyse for term of 500 yrs. from death of Richard Corbet upon trust for raising £500. Richard Corbet also covenanted if he should come into possess. of the rents of the Adderley estate to make provision of additional £500 p.a. to Eleanor Corbet for her life.

 

Recites indenture of 13 March 1830 in which Richard Corbet covenanted that if he should become entitled during the life of Vincent Roger Corbet by virtue of the will of Sir Corbet Corbet to possess. of the receipts of the Adderley estate as should remain after the trusts of the will prior to the trust to Richard Corbet for his life then Richard Corbet would pay to Vincent Roger Corbet during his life £300 p.a.

 

Recites indenture of 1 May 1838 (the marriage settlement of Vincent Roger Corbet and Maria Hunbleston (later Maria Corbet) in which Richard Corbet covenanted that if he, or any of his issue, should during the life of Maria Corbet under the will of Sir Corbet Corbet, come into possess. of the receipts of the Adderley estate prior to the trust for Richard Corbet for life then in the case of the d. of Roger Vincent Corbet leaving Maria Corbet succeeding him and there being one or more children of the intended marriage Richard Corbet would pay Maria Corbet an annuity of £300 for her life but if there should be no children of the marriage then an annuity of £150 only, both to cease on her remarriage.

 

Recites Indenture of 17 May 1852 (endorsed on indenture of 1 May 1838) in which Robert Mawdesley and Robert George Johnson were appointed trustees in place of Richard Corbet and Richard Houghton (deced).

 

Recites Indenture of 19 Nov. (1853) in which Richard Corbet and Henry Reginald Corbet granted to John Philpot and his heirs all the heredits. in Salop, Staffs. and Cheshire devised by will of Sir Corbet Corbet or which by purchase or otherwise became vested in the trustees of the will in which Richard Corbet was tenant for life and Henry Reginald Corbet tenant in tail to hold to John Philpot subject to the annuities in the will and to the charges and provisions in favour of Eleanor Corbet and the daus. and younger sons of Richard and Eleanor Corbet but freed from the estate in tail of Henry Reginald Corbet to hold upon such uses as Richard Corbet and Henry Reginald Corbet should declare. and in default of such declaration to the same uses as the same stood before this Indenture.

 

1a. and 1b. limit that the premises in the 1st and 2nd schedules but excluding the premises in the 3rd schedule shall, subject to the annuities in the will of Sir Corbet Corbet and the £500 for the daus. and younger sons of Richard and Eleanor Corbet remain upon uses hereinafter declared.

 

2b. with the consent of 1a. and 1b. quitclaims and 3. at the direction of 2b. and with the consent of 1a. and 1b. quitclaim to 7. all such part of the heredits. as were comprised in the Settlement of 1 March 1830 and all the interest claim and demand of 2b. and 3. in the premises to the intent that they be discharged from the rentcharge of £500 to Eleanor Corbet and from the powers, terms of yrs. and trusts therein created for securing its payment and also from the additional £500 jointure in the same indenture covenanted to be secured to 2b.

 

The premises in the 1st schedule to be charge in of the Adderley State with the £500 portions to the daus. and younger sons of Richard Corbet and also subject that if 2b. shall survive 1a. she shall receive a yearly rentcharge of £1,000 for her life in lieu of the jointure rentcharge of £500. and the additional jointure of £500. and in bar of all dower.

 

Provision for 2b. to enter onto the premises if the rentcharge is in arrears. and subject thereto to the use of 3. for term of 200 yrs. from the d. of 1a. to the use that 4a. may receive during his life a rentcharge of £300 in lieu of the yearly sum of £300 by the Indenture of 30 March 1830 the first half yearly payment to commence on 1st May next and if 4b. shall survive 4a. and as long as she shall remain his widow and if there shall be one or more of their children living at the time of the d. of 4a. she shall be paid a rentcharge of £300 and from the d. of such children or in case there shall be no children of 4a. and 4b. living at the d. of 4a. then £150 p.a. only - to be paid out of the heredits. in the 1st Schedule. Provision for 4a. and 4b. to enter upon the premises if the annuities shall be in arrears.

 

And charged as hereinbefore mentioned to the use of 5. for term of 300 yrs. upon trusts.

 

Declared that the term of 200 yrs. to 3. is to permit the person entitled to receive the rents etc. of the premises until default be made in the rentcharge of £1,000 to 2b. and then upon trust for them to raise the arrears out of the premises. The term to cease when the trusts have been performed or become unnecessary.

 

Heredits. and premises limited to 5. for term of 300 yrs. is upon trust that they shall permit the person entitled to the rents of the premises to receive then until default be made in the payment of the rentcharges of £500, £300 and £150 and then out of the premises to raise the arrears of the said rentcharges and when the trusts of the term of 300 yrs. have been performed or become unnecessary then the term shall cease.

 

The premises comprised in the first schedule (subject to the charges etc. created) and the heredits. in the second schedule shall be to such uses as 1a. and 1b. shall at any time direct and in default of such direction to the use that during the joint lives of 1a. and 1b. 1b. shall, so long as her shall remain unmarried, receive a rentcharge of £1,000 and if he shall marry a rentcharge of £1,500 out of the premises with provision for 1b. to enter upon the premises if it shall be in arrear and subject to the said rentcharge of £1,000 or £1,500 to the use of 1a. for his life and after the d. of 1a. to the use of 6. for term of 2000 yrs. from the date of these presents upon trusts and subject thereto to the use of 1b. during his life and after his d. to the use of the 1st and other sons of 1b. successively and the heirs male of such sons and in default of such issue to the use of Edwin Andrew Corbet the 2nd son now living of 1a. for his life and after his d. to the use of the first and other sons of the said Edwin Andrew Corbet and the heirs male and in default of such issue to the use of Athalstan Corbet the 3rd son now living of 1a. and his assigns for his life and after his d. to the use of his 1st and other sons and the heirs male and in default of such issue to the use of Rowland William Corbet the 4th son now living of 1a. and his assigns for his life and after his d. to the use of his first and other sons and the heirs male and in default of such issue to the use of Richard Auther Corbet the 5th son now living of 1a. and his assigns for his life and then to the use of his first and other sons and issue male and in default of such issue to the use of the 6th, 7th etc. sons of 1a. and their heirs male and in default of such issue to the use of 7. during the life of Sir Andrew Vincent Corbet upon trusts - and after the d. of Sir Andrew Vincent Corbet to the use of Andrew George Corbet the 2nd son now living of the said Sir Andrew Vincent Corbet for his life and after his d. to the use of his 1st and othersons and their heirs male and in default of such issue to the use of Reginald John Corbet the third son now living of Sir Andrew Vincent Corbet for his life and after his d. to the use of his 1st and other sons and their heirs male and in default of such issue to the use of Walter Robert Corbet the 4th son now living of Sir Andrew Vincent Corbet for his life and after his d. to the use of his 1st and other sons and their heirs male and in default of such issue to the use of the 5th, 6th etc. sons of the said Sir Andrew Vincent Corbet and their heirs male and in default of such issue to the use of 4a. and his assigns during his life and after his d. to the use of Robert Saint John Corbet the eldest son of 4a. during his life and after his d. to the use of the 1st and other sons of the said Robert Saint John Corbet successively and their heirs male and in default of such issue to the use of Frederick Vincent Corbet the second son of 4a. and his assigns during his life and after his d. to the use of his 1st and other sons and their heirs male and in default of such issue to the use of Everard Philip Corbet the 3rd son of 4a. and his assigns during his life and after his d. to the use of his 1st and other sons and their heirs male and in default of such issue to the use of Arthur Domville Corbet the 4th son of 4a. and his assigns during his life and after his d. to the use of his 1st and other sons and their heirs male and in default of such issue to the use of the 5th, 6th, etc. sons of 4a. and in default of such issue to the use of 1a. his heirs and assigns for ever.

 

Declared that the heredits. limited to 7. during the life of Sir Andrew Vincent Corbet are in trust to permit the rents of the premises to be paid to Vincent Rowland Corbet the eldest son of the said Sir Andrew Vincent Corbet during his life and after. his d. then to the 1st and other sons of the said Vincent Rowland Corbet successively etc. shall be without prejudice to the estate and interest of Sir Andrew Vincent Corbet

 

Proviso that if during the lifetime of Sir Andrew Vincent Corbet or after his d. Andrew George Corbet and all the other sons of Sir Andrew Vincent Corbet shall die without male issue then the estate for life shall be next in order of birth and with proviso for John Charles Burton Borough and Whitehall Dod to hold the rents and profits of the heredits during the minority of any tenants for life upon trust.

 

Heredits. limited to Henry Bayley Clive and Robert George Johnson for term of 2,000 yrs. are on trust that they shall at the d. of Richard Corbet, or during his lifetime if he shall direct, raise £32,000 out of the premises and pay the same to Richard Corbet.

 

Henry Reginald Corbet, after the d. of Richard Corbet, may charge the heredits. with £15,000.

 

Provision that if Eleanor Corbet should d. during the lifetime of Richard Corbet for him, or for any other tenants for life, to charge the estate with a rentcharge not exceeding £1,000 for their wives for their life, but such jointure by Richard Corbet not to exceed £500 p.a. Such rentcharges not to exceed £2,000.

 

Provision that any tenant for life may charge the estates with £15,000 as the portions of his children other than his eldest son but the premises not to become liable with a greater sum than £25,000.

 

Provision for selling and purchasing premises, and during the interval to place out the money received from such sale in government stocks. provision for the appointment of new trustees.

 

Provision for 1a. to charge the heredits. with annual sums not exceeding £100 apiece for each of his 3 daus. Mary Eleanor Corbet, Rachael Frances Corbet and Clara Anna Corbet so long as they shall remain unmarried to commence from the d. of 1a.
