Chancery Petition from Kenrick Collett, Chancery Lane, gent., William Williams, Middx., gent., Samuel Stoddart, Middx., esq., Elizabeth Stoddart wife of Samuel (formerly Elizabeth Meynell, widow), Charles Meynell, aged 18 and Francis Meynell aged 17, to establish whether legal estate in real estate devised by Frances Partheriche, Clopton, widow, by her will, dated 8 May 1792, is vested in Godfrey Meynell as heir at law of Hugo Meynell the elder or in Hugo Charles Meynell as heir at law of Charles Meynell and to recover arrears of rents and profits due to petitioners and unjustly detained by defendants in cause (named)

 

Reciting

 

(i) 8 May 1722 Will of Frances Partheriche, widow, devising real estate to use of Charles Boothby Skrymsher, esq. for life, then to trustees for uses.

 

a) Successive sons then heirs male of Charles B. Skrymsher. In default

 

b) To use of Edward Ingram, Barnet, Herts., esq. with remainder as above. In default

 

c) To use of John Ingram, Barnet, Herts., esq., as above

 

d) To Anthony Clopton, Ireland, gent., nephew of testatrix with remainder as above. In default

 

e) To right heirs of testatrix.

 

Proviso that whoever inherited was to live at Clopton House for three months each year and change their name to Clopton.

 

(ii) Death of Frances Partheriche, November 1792, and inheritance of C.B. Skrymsher who changed name. He was also heir general of Frances Partheriche and entitled to reversion in fee simple (i, e) subject nevertheless to tail male and successive remainders.

 

(iii) 21 July 1797. Will of Charles Boothby Clopton devising real estate of which he had power of disposal, to brother-in-law Hugo Meynell esq. and Hugo Meynell the younger, esq., (both now deceased) to sell to pay legacies with residue to sister Maria Noel.

 

(iv) C.B. Clopton died in July 1800 without issue.

 

(v) Entrance of Edward Ingram as tenant for life and death without issue in May 1818.

 

(vi) Entrance of John Ingram as tenant for life and his death without male issue on 20 November 1824, on whose death in absence of any claim by any heirs of Anthony Clopton who died 1777, heirs general of Charles Boothby Clopton presumably became entitled to trust estates in fee simple.

 

Further reciting

 

(vii) 4 Sept 1811 Agreement between Maria Noel, as residuary legatee and Charles Meynell, Ashborne, Derby, esq., for sale of reversion for £555, annuity of £333.6s.7d and trust for payment of legacies.

 

(viii) 30 July 1814 Will of Charles Meynell (d. March 1815) devising all real estates in possession and expectant, to Elizabeth Thomas his intended wife (now Elizabeth Stoddart, petitioner) for life, with remainder to Charles and Francis Meynell (petitioners), share and share alike.

 

On death of John Clopton, formerly Ingram, Elizabeth Meynell became life tenant and Charles and Francis Meynell tenants in remainder.

 

(ix) 24 and 25 Feb 1827. Lease and release by Elizabeth Meynell and Maria Noel, with consent of legatees under will of C.B. Clopton, to Kenrick Collett and William Williams, in trust for Elizabeth Meynell for life and then to legatees under the will of Charles Meynell.

 

(x) 24 Sept 1827 Marriage settlement of Elizabeth Meynell and Samuel Stoddart, vesting all real and personal estate of Elizabeth Meynell in William Williams as trustee, for her sole and separate use.

 

(xi) 14 Aug 1805 Will of Hugo Meynell the elder, who survived his son Hugo, devising real estate to his son Charles Meynell (since deceased) and his heirs.

 

(xii) Death of Hugo Meynell leaving his son Charles Meynell and Geoffrey Meynell as his heir at law.

 

(xiii) Death of Charles Meynell leaving Hugo Charles Meynell his eldest brother as heir at law.
