Description:
Petitioners: Richard de Sayton.
Name(s): de Sayton, Richard
Addressees: King and council.
Nature of request: Sayton requests that a writ be sent to the bishop to proceed with the plea concerning his removal by Aske from the tenements given to his father and mother. He was granted a writ of formedon by the bishop of Durham, but the justices of the bishop stopped the plea as Aske suggested that it was contrary to the statute of Westminster II. He asks for regard to be given that writs of right and mort d'ancestor pleadable in the liberty have been lopped by statute.1)
Nature of endorsement: Coram rege et magno consilio.2) The petition of the commune is answered in this case that have prayed that the king will of his grace grant to the bishop that he be able to plead such writs, thus supposing that such writs not to be able to be pleaded in the diocese now.

Note: The petition is difficult to date. Other petitions abound at this time complaining about the failure of legal procedures especially in relation to the discontinuance of the system of eyres throughout the county, and by extention in Durham, and of the inability to use certain writs in the county. These date to the period of vacancy between bishops Beaumont and Bury, and into Bury's pontificate (1333-4). While there is no evidence to date this petition conclusively to 1334, it does seem to fit the pattern of these other petitions (Cf. SC 8/44/2165; SC 8/74/3693; SC 8/206/10278; SC 8/311/15501; Fraser, Northern Petitions, pp.232-240).
