Petitioners: Richard de Berners.

Nature of request: Richard de Berners states that he arraigned an assize of novel disseisin before Henry Lespigurnel and his companions, against John, son of Edmund de Berners, Master John Walewayn and others named in the original writ, concerning his free tenement in West Horsley, Send, Wisley, Ockley, Ockham, Effingham and Chiddingfold, and the parties were adjourned to the Bench, before William de Bereford and his companions; but judgement in this case has been delayed, and is still delayed. He requests that the king order the justices to proceed to judgement, and, if there is some difficulty in the case, that the record and process may be brought into parliament now, and judgement rendered there.
Nature of endorsement: He is to have a writ of Chancery to the justices of the Bench that, because there has been a great delay in rendering justice, they should proceed to judgement according to the law.

Note: Date given on the evidence of Rot. Parl. JRS Phillips (PROME, Appendix of Unedited Petitions, 1307-1337) says that these petitions probably all do belong to 18 Edward II, although there is no indication that they were presented either at the non-parliamentary assembly of October 1324 or the parliament of June 1325. In this case, however, as parliament is specifically mentioned, this petition probably dates from June 1325.CPR 1317-1321 p.607 is dated at Westminster, 16 May 1321. This seems to be the association of two justices (one of whom is William de Bereford) in an assize, rather than an adjournment to either bench, so probably precedes the adjournment. The Bench in this case appears to be the Common Bench, as William de Bereford sat on that bench until 1324(Selden Society vol. 55, Select Cases in the Court of King's Bench: Edward I, vol. I, p.cxli).
