Short title: Whitehurst v Warner.

Plaintiffs: John Whitehurst and Thomas Amerye for themselves and other inhabitants and parishioners of the parish of Dilhorne.

Defendants: George Warner.

Subject: For support of a charity. Robert Warne deceased, and others, inhabitants of the Dulerne [Dilhorne], Staffordshire, having a sum of money to invest for the erecting of a grammar school, and providing a schoolmaster, purchased therewith certain lands in Kinwalmerche [?Killamarsh] and Kirkethorpe, Derbyshire, and applied the rents and profits according to said trust, which land afterwards became vested in the defendant as surviving feoffee, who had received other money to purchase a messuage and land in Fradley, Staffordshire, upon the like trust, which he neglected to do.
