Description:

Printed prize appeal from the Vice-Admiralty Court of Barbados.

Captured ship: Charles (master George E Avery).

Nationality: American.

History: bound from New York to Puerto Rico, laden with beef, pork, flour and provisions; taken on 5 January 1813 by HMS Tribune (George Reynolds commanding), and brought into Barbados.

Appellant: Stephen Miller supercargo for the ship on behalf of American citizens, and for the cargo on behalf of British and Swedish subjects, as protected by licence from Henry Sawyer, Vice-Admiral at Halifax station, of from Don Luis de Onis, Spanish envoy to the US; And James Smith merchant of London for part of the cargo on behalf of James McGreggar, Swedish subject.

Respondent: The captor and HMPG.

Bound printed appeal with manuscript decree of 12 July 1814 (folios 430-445) [no folio 444].

Decision: against the appeal for the ship and that part of the cargo claimed as American property; subject to further proof for the cargo claimed as Swedish property.
