Description:

Printed prize appeal from the Vice-Admiralty Court of the Cape of Good Hope.

Captured ship: Philip Dundas (unknown master).

Nationality: British.

History: first captured by a French privateer and taken into Isle de France [Mauritius]; recaptured in December 1811 by HM Land and Sea Forces on the taking of the island; at the time of recapture the ship was said to be unseaworthy.

Appellant: William Colvil Learmouth of Cape Town for the ship on behalf of D'Abdul of Penang, British subject.

Vice Admiral Sir Albermarle Bertie and Lieutenant General John Abercromby.

Bound printed appeal with manuscript decree of 14 May 1817 (folios 437-443).

Decision: against the appeal, ship condemned as lawful prize.
