Description:

Printed prize appeal from the High Court of Admiralty.

Captured ship: Diomede.

Nationality: French.

History: a French warship with 620 men, part of a French squadron defeated and destroyed in the battle of San Domingo on 6 February 1806 by a squadron under Admiral Sir John Thomas Duckworth.

Appellant: 1) Vice Admiral Sir John Thones Duckworth kt and Vice Admiral Richard Dacres, commander-in-chief of HM ships and vessels in the Jamaica station.

Respondent: Lord Collingwood, Vice Admiral John Knight and Rear Admiral William Earl of Northesk - Knight and Northesk claiming an interest in the flag eighth of the capture and headmoney arising therefrom; 2) Rear Admiral Sir Alexander Cochrane kt, commander-in-chief of HM ships and vessels in the Leeward Islands station v Lord Collingwood, Vice Admiral John Knight and Rear Admiral William Earl of Northesk.

Bound printed appeal with manuscript decree of 24 February 1810 (folios 490-505).

Decision: against the consolidated appeal and affirmed the sentence appealed from.
