Description:

Printed prize appeal from the Vice-Admiralty Court of Nova Scotia.

Captured ship: Messenger (master Daniel Butler).

Nationality: American.

History: bound from Guadeloupe to New York, laden with sugar, indigo, cotton, yams, sweetmeats and coconuts [cocoa nuts?]; taken on 24 October 1806 by HMS Cambrian (John Poo Beresford commanding) and HMS Bellona (John Erskine Douglas commanding), and brought into Halifax.

Appellant: The master for the ship and cargo on behalf of Nicholas G Rutgers and Benjamin Seaman merchants of New York, American citizens; and for the private adventures of the H G Rutgers supercargo.

Respondent: The captors and HMPG.

Bound printed appeal with manuscript decree of 30 November 1808 (folios 171-181).

Decision: ship and cargo to be restored.
