Description:

Printed prize appeal from the Vice-Admiralty Court of Nova Scotia.

Captured ship: Thomas (master Jonathan Smith).

Nationality: American.

History: bound from Cayenne to New York, laden with dye wood, furniture, simarouba [wood] and gunpowder; taken on 23 August 1804 by HMS Leander (Alexander Skerne commanding), and brought into Halifax.

Appellant: The master for the ship and cargo on behalf of himself and John P Durand of New York, American citizens; for the cargo on behalf of said John P Durand.

Respondent: The captor and HMPG.

Bound printed appeal with manuscript decree of 18 April 1807 (folios 97-131) [no folios 104, 115, 126, 128].

Decision: ship and cargo to be restored subject to payment of the captor's expenses.
