Description:

Folio 244.

To: The General Board of Health.

From: George Bailey, Clerk to the Luton Local Board, Luton [Bedfordshire].

Subject Matter: Letter requesting an opinion on the expenses of the repairs and maintenance of Bute Street which is owned by the Marquis of Bute, together with the adjoining land on both sides. Bailey explains that the land was sold and built on, which the public have already had the right and use of passage over, but there was no formal dedication of the street as contemplated by the General Highway Act or the Public Health Act 1848. He asks whether Bute Street is a public street repairable by the inhabitants, or whether it is a street that can be paved and channelled in accordance with section 69 of the Public Health Act 1848, and the expenses charged on the owners through the Private Improvements Expenses. He also adds that since 1852 no repairs have been carried out by the Local Board.
