Description:

Esther By survived her husband only two years, died on 18 February and was buried at Frant on 27 February 1838 at the age of 40. The suit By v Barker was brought in chancery to administer Mrs By's estate, and another suit, By v By, to make her two infant daughters wards of the same court

 

A proposal for a marriage to Esther March By, the younger daughter, was received from the Hon Percy Ashburnham, the second son of George, 3rd Earl of Ashburnham, in July 1838; the marriage took place the following month

 

This group of documents contains the case-papers in both suits, a valuation of Miss By's fortune, rentals of the Shernfold estate and details of the settlement on the marriage. For the correspondence bundle, see AMS6417/1/52
