Draft assignment of terms in trust made between 1. Robert Holden of Aston esquire 2. Joseph Greaves of Ingleby gentleman trustee for Holden 3. Reverend John Rolleston, Rector of Aston, another trustee for Holden 4. John Lowe of Park Hall, Denby, gentleman son and heir of John late of Park Hall gentleman deceased by Dorothy his wife 5. Sir William Heathcote of Hursley Lodge, county Southampton 6. John Parker of the Exchequer at Westminster esquire and 7. William Mills of Leek, county Stafford gentleman reciting that the late John Lowe on 14 Feb 1720/1 demised to John Lowe the son capital messuage called Park Hall, lands belonging, house and croft in possession of Josua Harris, house and lands in possession of Anthony Cadman, house and lands in possession of widow Harrison, Joseph and Roger Harrison, closes in possession of Paul Brentnall, estate for life in 2 closes in possession of John Bardell with coppice, and in house and lands in possession of Jonathan Hall, house in possession of Patrick Parkin, close in possession of Richard ?Byley or Ryley, 2 closes in possession of John Smith, closes in possession of Joseph and John Barber and coppice, estate for life in B?yards Pingle and 2 parcels of land called Shardlow Pingles in the possession of John Lowe the elder, and close divided into two in the possession of Joseph Hunt (gives annual values) all in the parish of Denby, for 999 years, paying rent to Lowe the elder of £100 for his life and paying to John Lowe or Dorothy his wife for her support and that of the younger children, Charles, Dorothy, Anne, Prudence, Jane, Elizabeth and Theodosia, £60 per annum, to Charles Lowe £12 10s a year until 21 and £500 at age of 21, to each daughter after Lowe the elder's death £12 10s annually until 21, then £300 a piece, paying the debts of John Lowe the elder amounting to about £1,000 except debts as related to the coal mine at Nether Eastwood, county Nottingham, and paying to the minister of Denby 20s annually and 6s 8d to poor of Denby and reciting that in indenture dated 26 June 1734 made between (1) John Low the younger of Park Hall, Denby, gentleman (2) John Low the elder of Park Hall, Denby, gentleman and (3) Dorothy Baggaley widow, Anne, Prudence, Jane, Elizabeth and Theodosia Low (1) demised to (2) farm in occupation of John Barber, messuage and lands in occupation of widow Harrison, Joseph and Roger Harrison, messuage and lands in occupation of Samuel Harrison, farm and lands in occupation of William Harrison, farm and lands in occupation of John Harrison, farm and lands in occupation of widow Bardell and Bottles Meadow in the occupation of John Lowe the elder, for 500 years providing that if (1) pays (2) £100 per annum for life and pays his debts before Michaelmas next, which were owing on 14 Feb 1720/1 (excluding debts relating to coal mines at Nether Eastwood), pays sums to the minister and poor of Denby as above, and within 3 months of (2)'s death pays to each of (3) £300 a piece, then the demise is void, and reciting that on 26 June 1734 John Low the elder of Parkhall, Denby, gentleman assigned the premises in deed recited immediately above to John Low son and heir of Vincent Low of Denby esquire for the remainder of 500 year term in trust to provide £10 per annum for John's wife and for each of his daughters during his life, the £70 to come out of the £100 per annum due to John Low under deed immediately above and reciting will of John Low the father dated 9 Nov 1737, that he died 4 Feb 1737/8, that the only younger children surviving were Prudence, Jane, Elizabeth and Theodosia, whose portions of £300 a piece were the only charge remaining on the premises charged therewith and that John Lowe had borrowed £1200 to discharge these portions from Robert Holden, reciting release of 27 August 1741 (see D 779B/E 103) in 6 parts by which John Lowe of Park Hall and his sisters confirmed to Joseph Greaves the premises in deed of 26 June 1734 transferred to John Lowe of Denby in trust, for remainder of term of 500 years, in trust for Robert Holden, and by which further, John Lowe of Park Hall set over to John Rolleston the premises mentioned for a term of 999 years in trust for Robert Holden, subject to redemption by payment of £1248 by John Lowe of Park Hall to Robert Holden and witnessing that for £1272 paid to Robert Holden by William Heathcote, part of £1600 mentioned in D 779B/E 103 and for 5s paid to Greaves by John Parker and 5s paid to Rolleston by William Mills, Greaves by the direction of John Lowe and Robert Holden and at Heathcote's nomination, assigned to Parker the premises recited in 1741 deed for remainder of term of 500 years in trust for Heathcote and Rolleston at the same direction and nomination assigned to Mills the premises in 1741 deed for remainder of term of 999 years in trust for Heathcote.
