General session of the peace held at Maidstone on Tuesday after Michaelmas, 28th September, 1602, before Thomas Fludd, John Leveson, George Delves, Thomas Waller, knights, Martin Barneham, esqs., and others.

 

Precept of venire facias for the sheriff, Thomas Scott, esq., ........... returned.......... defaulters fines assessed at 13s. 4d. Certain of the constables, Reginald Keyle, Thomas Stace, Stephen Hasell, John Bennett, William In glett, Richard Ellett, Geoffrey Netter, Abraham Hope, Richard Pygott, John Crane, Thomas Godden, John Hyckmott, Edward Rode, George Lucke, Thomas Underhill, John Fagg and John Smeede, present.

 

1 Christopher Hayward, labourer, and William Smythe, labourer, both of Chilham, on 5th August, 1602, at Chartham, broke and entered into the close of Hamon Watson of Boughton-under-Blean and assaulted his wife Florence.

 

Writ of venire facias for them to appear at the next session at Canterbury on Tuesday after Epiphany next [12th Jan. 1602/3], on which day the sheriff, Peter Manwood, esq., returns nichil habent. Therefore writ of capias to have them at the next general session.

 

[In margin] 10th Jan. 1603/4 denied the indictment.

 

2 Giles Allyson of Addington, labourer, riotously assembled together with other people unknown to the number of three, armed with staffs and knives on 21st September, 1602, at Maidstone, and broke and entered into a close of John Brooke, gent. , and assaulted him.

 

Writ of venire facias as above, on which day sheriff returns nichil habent, therefore writ of capias as above, which day at Maidstone on the Tuesday after the Close of Easter [17th April, 1603] the sheriff reports cepit corpus of Giles. He appears and asks to be admitted to a fine. His fine assessed here by the justices at 5s. , paid to the sheriff for the use of the crown. Therefore the said Giles may be discharged.

3 Giles Coucheman, yeoman, and Dorothy, his wife, John Packe, tailor, and Agnes Beale, spinster, all of Tonbridge, with other unknown wrongdoers to the number of four, riotously assembled together, on 14th April, 1602, at Tonbridge, and armed with swords and staffs tipped with iron, illegally climbed the walls of a close of Thomas Couchman at Tonbridge and assaulted Francis Couchman, servant of Thomas.

 

Writ of venire facias for them to appear [as above], sheriff returns nichil habent. Therefore writ of capias to have them [as above]. On which day at Maidstone on Tuesday after the close of Easter [17th April, 1603] the sheriff returns cepit corpus of Giles but that the other defendants non sunt inventi. Giles [as above]. His fine is assessed by the justices at 2s. to the use of the Crown. Certified that the other defendants have not come. Therefore writ of sicut prius capias [sic] to have them at the next.

 

[In margin] 2s. On 2nd September, 1603, John Packe appeared and discharged by pardon.

 

4 Barnard Trewman of Aylesford, husbandman, on 8th May, 1602, at Aylesford shot "a fowling peece" "charged with powder and hayleshott" at a partridge.

 

Writ of venire facias for him to appear [as above], sheriff returns nichil habet, therefore writ of capias to have him [as above].

 

[In margin] Discharged.

 

5 John Bennett, junior, of Maidstone, barber surgeon, on 12th September, 1602, at Maidstone, assaulted Henry Bayes of Maidstone, innholder, wounding him.

 

Writ of venire facias for him to appear [as above], the sheriff returns nichil habet, therefore writ of capias to have him [as above].

 

6 Since Thomas Scott, esq., lately sheriff, by reason of a writ of attachment from the Court of Common Pleas at the suit of John Webbe, gent., on a plea of trespass, made a warrant to Henry Bayes of Maidstone, innholder, for the arrest of Thomas Reve, junior, of Maidstone, yeoman, to reply to the said John, Henry Bayes on 21st June, 1602, arrested Thomas Reve and had him in his custody when Thomas assaulted him, striking him violently on the head with a dagger worth 2d. and also wounding him with a staff and escaped.

 

Writ of venire facias for him to appear [as above], the sheriff returns nichil habet and therefore writ of capias to have him [as above].
