In consideration of a marriage already had between William Wolryche and Dorothy one of the daughters of Thomas Poyner, William Wolryche covenants before the Nativity of St. John the Baptist next to convey to Thomas Poyner and to Robert Pygott and Thomas Screven' esqs, Francisse Gattacre, William Poyner, Franceis Muckelowe, Rychard Broke, Thomas Pygott, Franceis Wolryche, Edward Screven, William Whytcombe, John Poyner and John Byest, gents. the Manor of Dudmaston and all his property in Dudmaston, Prestopp, Whytley Fields, Claverley, Cotton, Asteley, Alveley and Quatt, to uses. As concerning lands and tenements of William Wolryche of the yearly value of £39 16s 10d in Prestopp, Whytley Fields, Cotton, Asteley, Claverley, Alveley and Quatt (Rychard Persons, John Wedgewood, Homfrey Gough, Foulke Persons, John Baule, John Wannerton, Thomas Hadeley, John Hadeley, Homferey Potter, John Potter, Thomas Wyks, Rychard Payne, Thomas Hooke, Symon Hadley, John Dovye, James Reignolds, Gyles Jurden, John Pryce, Richard Hyll and Elizabeth Broke, widow) to the use of William and Dorothy and their corporeal heirs, and in default to William and his heirs forever; and concerning the residue of the property of William, to the use of William and his heirs by Dorothy, in default to William and his heirs forever. Provided that if Dorothy dies in the lifetime of William, then William for the jointure of any other wife or preferment of his children, or payment of his debts and performance of his will, demise, grant, let or devise the property appointed to be the jointure of Dorothy and all the profits of the same for 3 lives or less or 20 years or less. If William dies in the lifetime of Dorothy he may let property worth £20 p.a., except those appointed for her jointure and the capital messuage of Dudmaston, for 3 lives or 20 years or less; and also by his will bequeath the profits of the residue of the property of William Wolryche'other than Dorothy's jointure and the £20 land, from the death of William until his right heir is 16, to such purposes as he by will appoints. If William shall discontinue the freehold or inheritance of the estate in tail special in any part of the premises by fine or recovery, then immediately the estate in these presents first covenanted to be made concerning the lands and tenements discontinued shall be and all persons seised of it shall be seised to the only use of Dorothy for her life, and after her death to the use of the heirs of Wm and Dorothy, and in default to Wm and his heirs forever. Wm Wolryche covenants with Thos Poyner that the property appointed for Dorothy's jointure shall be during her life discharged from all former grants etc.

 

Thos Poyner covenants he and his heirs before next Nativity of John the Baptist to convey to Wm and his trustees to uses the Manor or chief mansion house of Beslowe and all houses and lands of Thos P. belonging, being the demesne lands or usually occupied with the same, in Beslowe, and a pasture in Wroxeter - the Lee Croft, a meadow - the Lee Meadow, and one tenement in Uppyngton, 2 pastures called Domesmore (now or late John Pavyor and Rychard Hotcheks) and woods in the Lordship of Leighton in the common wood there between the place called Roche Greene and the New Copye and so down to Leightons field and Garmystonfield, and the parcel of wood ground called the New Copye in the lordship of Leighton; one tenement (Elizabeth Wryght), one tenement (Wm Wryght), one tenement (John Wryght), one tenement (Anne Woorall and John Woorall), one tenement (Margaret Tart), one tenement (Wm Pomfort), one tenement (Margaret Coley), one tenement (Elizabeth Sankye), one tenement (John Woorall), one tenement and cottage (Thos Boycote) the estate of Thomas Poynor with the several tenements and cottage now demised or occupied, and in one pasture called the Myll Croft (John Wryght), a pasture called Styllgose Meadow (Wm Wryght and Margarett Tart), a pasture - the Bache (Wm Wryght), a croft (Eliz.Sankye), 7 acres of land in Adeley, a pasture called the Church Bache, a pasture called the Lytle Ree, a pasture called the Mutche Ree, 2 pastures called the Rydons, and the woods in the lordship of Leighton between the New Coppye being also in the lordship of Leighton and between the lordship of Little Wenlock and Buildwas (Buyldoes) severally in the townships, parishes, hamlets or fields of Wroxeter, Leighton, Garmyston and Eyton Constantyne (except the property of Thos Poynerand that which Wm Wolryche lately bought of the Queen); and all the property of Thos Poyner (now or late Thomas Longnor, Thomas Hancocks, Thomas Coley, Rychard Lye, Jone Poyner, Thomas Lye, Nycholas Foxe, Edmond Hancocks, Lucye Lowe, Thomas Blakewey, Elizabeth Longmore, Thomas Hancoxe, Jone Poyner, John Blakewey, Thomas Poyner, Thomas Fareley, Roger Baggeley, Jone Maunsell, Elizabeth Longmore, Thomas Blakewey, Richard Maunsell, Eleyn Allen, Thomas Whytcomb and Anne Bourton, being in the townships etc. of Donnyngton, Drayton, Wroxeter, Preston of the Bootes, Morley and Upton under Haghmond, except the property bought from the Queen.

 

As to the chief mansion house of Beslowe and all the lands and tenements belonging and taken as the demesne lands and all other premises in Beslowe and property in Wroxeter and Uppyngton (now or late John Pavyor and Richard Hotcheks) and the woods in the lordship of Leighton in the common woods between Roche Greves and the New Copye down to Leightons field and Garmyston field and the parcel of wood ground - the Newe Copye part of the premises, to the use of Thos Poyner for life, then to Dorothy and their corporeal heirs, in default of T.P.'s corporeal male heirs but if T.P. has corporeal male heirs, then after the death of Thos P. to such male issue of T.P. and his corporeal male heirs, in default to Dorothy and her corporeal heirs by Wm W., in default to the use of the corporeal heirs of Dorothy, in default to Isabell Poyner, one other of the daughters of Thomas Poyner and her corporeal heirs, if Thos Poyner in his lifetime does not limit or appoint the same to any other person and to their heirs for so long as Isabell and her corporeal heirs shall continue, and if any such limitation or appointment in writing is made, then to the use of such person(s) and their heirs as Thos Poyner by writing names for so long as Isabell or any of her corporeal heirs continues, and in default of such issue then to the use of the right heirs of Thomas Poyner forever.

 

As for the lands and tenements of Thomas Poyner in Preston of the Botes, Morley and Upton under Hamound (now or late Roger Baggeley, Thomas Blakeley, Jone Maunsell, Elizabeth Longnor, Rychard Maunsell, Elleyn Aleyn and Anne Bourton) parcel of the premises of the yearly value of £10, the estate shall be to the use of Thomas and Elleyn now his wife and of the male heirs of Thomas by Elleyn, in default to the use of the corporeal heirs of T.P. by Elleyn. If Thomas P. hereafter has any daughter(s) by Elleyn other than Dorothy and Isabell, and if he has no such daughters, then as for ½ of of the last premises, the estate shall be to the use of Dorothy and her corporeal heirs by Wm W., and in default to the use of the corporeal heirs of Dorothy, and in default of these to the use of Isabell Poyner and her corporeal heirs (if Thomas Poyner in his lifetime does not limit and appoint the same to any other person(s) and their heirs slc long as Isabell or her corporeal heirs shall continue, in default to the right heirs of Thomas Poyner forever. As for the other ½ of the estate, to the use of Isabell Poyner and any corporeal heirs of hers (if T.P. does not limit the same to any other person), in default of usch heirs to the use of Dorothy and her heirs by William Wolryche, in default to her corporeal heirs and in default to the right heirs of Thomas Poyner forever.

 

As for the lands etc. of Thomas Poyner in Donnyngton, Drayton and Wroxeter (now or late Thomas Longnor, Thomas Hancocks, Thomas Coley, Richard Lye, & Jone Poyner, Thomas Lye, Nicholas Foxe, Edmond Hancocks, Lucye Lowe, Elizabeth Longnor, Thomas Hancoxe, Jone Poyner, John Blakewey, Thomas Whytcombe) except before excepted, part of the premises of the yearly value of £6 13s 4d - the estate shall be to the use of Thomas Poyner for life, then concerning the one moiety, to the use of Dorothy and her corporeal heirs by William Wolryche, if Thomas Poyner has no male issue, but if he has, to the use of the same and his male heirs, in default to Dorothy and her heirs by Wm W., in default to the corporeal heirs of Dorothy, in default to the use of Isabell Poyner and her corporeal heirs, if not limited to Thomas to anyone else, in default to the right heirs of T.P.forever. As for the other half, after the death of Thomas Poyner, to the use of the corporeal male issue of Thomas Poyner and his male heirs, in default to Isabell Poyner and her corporeal heirs unless limited by T.P. to other persons, in default to Dorothy and her corporeal heirs by Wm, in default to the right heirs of T.Poyner forever.

 

As for the residue of the property of Thomas Poyner, except as before excepted, to Thomas Poyner for life, then to his corporeal male heirs and such heirs' male heirs, and default to the use of Isabell and her corporeal heirs, in default to Dorothy and her corporeal heirs by Wm, in default to her corporeal heirs, in default to the right heirs of Thomas Poyner forever. Various other provisions.

 

If Thomas Poyner has issue male by Elleyn his now wife, then Thomas Poyner shall pay to William Wolryche at the parish church of Wroxeter 500 marks thus - on the last day of one whole year next after the christening of the son between 9-11 a.m. 100 marks, and the same day a year later 100 marks and from then on yearly 100 marks until the 500 marks has been paid. If Thomas Poyner after the death of Elleyn without male issue has a son by another wife, then Thomas Poyner is to pay William Wolryche 600 marks at a time similar to the above, 100 marks a year. Provisions for repayment if Thomas Poyner or his male heirs die after payments have been made.
