Lease and Release with counterpart of release.

 

1. William Wood of Little Russell Street, parish of Saint George, Bloomsbury, co. Middx., cider merchant and Frances his wife, only child and heir of Herbert Haselden late of Stepney in the fields, co. Middx., grocer and tobacconist, grand daughter and heir of Magdalen wife of Robert Haselden late of Over Hulton, co. Lancs., who was one of three devisees in fee under the will of Herbert Howorth of Burghill co. Hereford, and one of five sisters and co-heirs of Herbert Howorth.

 

2. William Downes of the city of Hereford, gent.

 

Recites will of Herbert Howorth and the deaths of Herbert Howorth, Magdalen Haselden and Robert Haselden.

 

Consideration: £100 paid now and £1,000 to be paid as soon as Downes' title is secured by judgement of a court of law with interest of 5% per annum paid half yearly.

 

Now (1) convey to (2).

 

A third part of the manor of Whitehouse Alias Jenkin ap Richard: capital messuage called Whitehouse and its appurtenances in Vowchurch Turnaston (sic), Saint Margarets, Clodock, Bacton and Newton: messuage called the Gilva in Saint Margaret's, Bacton and Newton: meadow or parcel of meadow near the Rock, parish of Saint Margaret's: two tenements at Turnaston in the possession of Francis and Henry Howells. To be conveyed subject to the payment of Herbert Howorth's unsatisfactory debts.

 

Also (1) assign to (2) a third part or any lesser share of the rents and profits of the property from the time of Robert Haselden's death and appoint him their attorney to receive the rents.

 

Lease marked E docketed "In Chancery between William Wood and Francis his wife Plts. and William Downes Deft. I undertake to admit the Execution of this Deed marked (E) by the said William Wood and Frances his wife on the hearing of this Cause without proof thereof by the Subscribing Witness. Dated this 19 day of September 1807. B. Fallowes".
