4. The Hon. Albemarle Bertie, Swinstead, Lincs. Esq., & Mathew Boucheret, Willingham, Lincs., Esq.

 

5. Charles Montagu Bertie, Uffington, clerk, & John Tryon, Colly Weston, Northants.

 

Recites: 1) 1. being seized of manors and lands hereinafter mentioned, with remainder to his heirs in tail male. Agreed between 1. and 2. that a sum not not exceeding £1,500 should be raised to pay debts of 2. and provision should be made for his present maintenance and that in consideration thereof 1. could charge £500 towards portions of younger children & 2. should be made tenant for life in all the said manors, lands etc. with remainder to his heirs in tail amle.

 

2) Bargain & sale of 18th Sep. last in pursuance of said agreement 1. & 2. to 4. Manors of Uffington, Tallington, & Newstead with apps., dissolved Monastry of Newstead, Advowsons of Uffington & Tallington, and all lands of 1. to 2. in Lincs. Rectory of Gt. Stewkley., Manor House of Gt. S., Camoyes Manor etc., Moiety of Manor of Broughtons, Hunts Closes in Molesworth All property of 1. & 2. in Hunts. late Mary Morborne's to suffer 2 Common Recoveries in favour of 4.

 

3) Levying of said Recoveries.

 

Now declaration of uses of same. Hunts Closes & messuage there to sell & pay off the mortgage of 10th Dec. inst. & any surplus to 1. & 2. equally.

 

Stewkley Hall & Rectory with Hill Close, Lye Close & the Warren Close in Stewkley. The Cottage Lands, the Warren & Turners Land, 3 closes called Kilburns Closes, The Abbotts pasture, all in the tenure of Thomas Bradshawe in Gt. S. Messuage there now or late in occup. of Richard Flowers. Larburys Cottage, the Woodground Close, the Bardolphs Field, the Crowe Close, now or late in occup. of Rich. Flowers; Woodsons Field And Carters Close now or late in occup. of Henry Adrews; Gt. Bennetts pasture now or late in occup. of John Webster; Sylvester Dawes Cottage now or late in occup. of Sylvester Dawes. Cottage now or late in possession of Wm. Linnage; Cottage with yard now or late John Lenton; cottage & homestead, now or late William Setchell; cottage or homestead now or late Thomas Fox; cottage now or late Daniel Maul's; with all apps.

 

To use of 2. for life then to 4. during life of 2 on trust to preserve the contingent uses, rents etc. to 2. for life.

 

After death of 2. and property not so far declared, to 1. for life, then to 4. during life of 1. on trust to preserve the contingent uses, rents etc. to use of 1. for life then to use of 5. for 400 years on trust.

 

After determination of term, except premises already limited to 2., to use of 2. for life then to use of 4. during life of 2. on trust to support the contingent uses, rents etc. to 2. for life.

 

Premises limited to 1. for life. After determination of those estates to use of heirs of 2. in tail male. If none to use of Peregrine Bertie, 2nd son of 1. for life then to 4. during life of said Peregrine to preserve the contingent uses - Peregrine to have rents etc. for life. After his death to use of his heirs in tail male. If none to use of Norborne Bertie, 3rd son of 1., similarly.

 

If none, to right heirs of 1. for ever.

 

The said term of 400 years limited to 5. upon the following trusts.

 

To raise money for the portions of the younger children of 1. not exceeding in the whole £500 as apptd. by 1., and 1. allowed to raise £300 from premises for joynture of possible wife, and sons allowed to raise joyntures from premises of £100 p.a. for every £1,000. No portion to exceed £6,000.

 

1. and 2.& his bros. allowed to make leases and demises, except of the Manor House of Uffington with apps. and closes - Coney Green, Upper and Lower Horshoe(?); Horne with the meadow Close & Newstead Close & the Island there for 21 years or less but not in reversion.

 

Endorsed: The original Deed and with other deeds wanting are in Mr. James Main's hands.
