Indenture (quadripartite) Parties. Will. Atherton of Preston, mercer, Thos. Simpson, John Waddington, of the first part. Robert Leigh of Chorley, gent. and John Walmesley of Wigan, gent., and James Anzlark of Dukesbury, yeoman, second part; and Geo. Farington & Will. Anderton, 3rd part, and John Anderton of Liverpool, of the fourth part.

 

Reciting by indenture bearing date 20th and 21st Oct. last past, made between Edward Master of Wigan Esq. (father of James Master, who was son and heir of Alice Master, deceased, late wife of the said Ed. M., which said Alice was in her lifetime the eldest of the four sisters and co-heirs of Thos. Robinson, late of Euxton, deceased, and also one of the four co-heirs of John Robinson, gent, deceased, son and heir of the said Thomas Robinson) Thomas Catterall, then late of Wigan, then of Euxton, aforesaid, gent. (son & heir of Peter Catterall, late of the Crook within Shevington, gent, deceased, and of Anne, then late wife of the said Peter C. likewise deceased who was one other of the four sisters and co-heirs of the said Thos. Robinson, and also one of the four co-heirs of the said John Robinson) Eleanor West of the city of London, widow (another sister and co-heir of the said Thos. Robinson, and one other of the co-heirs of the said John Robinson) and John Brown, then or then late of Chorlestown, South Carolina, gentleman, and Lucy his wife (which said Lucy is another sister and co-heir of the said T. Robinson, and one other of the co-heirs of the said John Robinson of the first part, Joseph Brock, citizen and merchant taylor of London, Phillip Wiltshire of the hamlet of Ratcliffe in the parish of ............in the County of Middlesex, and Stafford Morgan of the same Hamlet cheesemonger of the second part and John Richardson of Preston the third part the said Robert Legh and John Walmisley and James Anzlark fourth part and William Atherton Thomas Simpson and John Waddington fifth part after a recital in the now reciting indenture the several mortgages and conveyance from the said Thomas Robinson and others claiming under him of his messuage lands etc. situate in Euxton Burgh Chorley and Charnock Richard subject to such redemption as is mentioned and after a recital of other conveyances of a fine levied of the premises by Edward Master Thomas Catterall and Cecila his wife Eleanor West John Brown and Lucy his wife to William Shaw since deceased and to the said John Richardson and of the deed declearing the uses thereof and vesting the premises thereof; comprise in the said John Richardson upon trust to sell the same and to dispose of the monies till such sale for the purposes mentioned and likewise of an order in the Court of Duchy Chamber of Lancaster at Westminster made the 17th June 1722 in a cause etc. etc. whereby it was decreed that Joseph Brock should on the payment of principal etc. etc. should convey and procure his trustee Philip Wiltshire to convey the said mortgaged premises to the plaintiffs and after a report and order that there was due to the said Joseph Brock and Stafford Morgan the sum of £1918.6s.4d. a part of which Stafford Morgan was entitled and that Robert Legh and John Walmisley and James Anzlank had contracted etc. for the lands etc. in the mortgage mentioned (here follow directions and instructions as to the payment of the monies secured and to the amount and to whom the share in the monies shall be paid) and reciting that the said George Farrington and William Anderton before the execution of the recited indentures of the 20th and 21st of October last past upon the assurance given to them by Robert Legh John Walmisley and James Anzlark of being admitted to be the purchasers of the premises to be hereby granted did advance £635 as their the said Goerge Farrington and William Anderton share of the sum of £1918.6s.4d. of the sums of money paid to the said Edward Master Thomas Catterall Eleanor West End Lucy Brown in respect of the said messuage. It is witnessed that in consideration of the sum of £635 they William Atherton Thomas Simpson and John Waddington by the direction of the said Robert Legh John Walmisley and James Anzlark have granted unto George Farrington and William Anderton (in their actual possession by virtue of the last preceding indentur D/D An/Bundle 41/363) All that the messuages and premises comprised in the preceding indenture for ever.

 

A Covenant by the said John Anderton to produce the aforementioned indentures of Lease and Release.
