All references to 'the Earl of Egremont', in the following section of this catalogue should be taken as meaning George O'Brien Wyndham, 3rd Earl of Egremont, unless otherwise stated

Provenance of the Documents

The records of the River Rother Navigation form part of the archives of the southern estates of the Wyndham family at Petworth House, West Sussex. These documents, although remaining at Petworth House, are under the care of the Library and Archives Committee of the West Sussex County Council, and may be consulted in the West Sussex Record Office at Chichester during normal office hours, providing that application is made at least one week in advance

The navigation was administered from the Estate Office at Petworth and consequently the records of the navigation are to be found among the general series of estate records. A small number of the navigation records - plans and account books - have been catalogued in The Petworth House Archives [F.W. Steer and N.H. Osborne (eds.) The Petworth House Archives, Vol. 1, 1968.] and to make the present catalogue comprehensive these catalogue entries have been repeated in the appropriate sections (these records have a four-figure catalogue mark). The bulk of the navigation records retain the Estate Office number probably given to the documents in the mid-nineteenth century and derived from their location at Petworth (this is a multiple number commencing with the letters OF)

In the course of cataloguing the records it was discovered that closely related documents frequently appeared out of order in the bundles. In order to make this catalogue more easily usable therefore, the catalogue entries have been placed in chronological sequence in each bundle, and an attempt made to reconstruct, on paper, something of the original order of the documents. It should be emphasised that this re-sorting does not extend to the physical order of the documents, which remain in numerical order in the bundles

This group of documents contains the papers for the various actions brought by the Earl of Egremont against Stoveld between 1815 and 1817

This group of documents, the largest single group in the River Rother Navigation records, contains 303 individual items and in view of bulk and technical nature of the papers it was not considered appropriate to include a detailed catalogue of the majority of the records in the present volume

The Rother Navigation Act, 1791 (31 George III, c. lxvi), [An Act to enable the Earl of Egremont to make and maintain the River Rother navigable, from the Town of Midhurst, to a certain Meadow, called the Railed Pieces, or Stopham Meadow, in the Parish of Stopham, and a navigable Cut, from the said River to the River Arun, at or near Stopham Bridge, in the County of Sussex; and for other purposes. 11 April 1791.] permitted George Wyndham O'Brien, 3rd Earl of Egremont 'to make and maintain the said River Rother navigable and possible for Boats ... from or near the said Meadow or Close of Land called The Lower Platt, in or near the said Town of Midhurst, in, through, or near the parishes of Woollavington and Easebourn ... the Tything of Ambersham, in the Parish of Steep ... and also in, through or near the several other Parishes of Selham, Lodsworth, Tillington, Burton, Duncton, Petworth, Sutton, Coates, Egdean, Fittleworth, Bury, Coldwaltham, and Stopham ... to and into the said Meadow or Close of Land, called the Railed Pieces, or Stopham Meadow, in the said Parish of Stopham; and also to make and maintain a Cut or Canal ... from the said River Rother, through or near the said Meadow or Close of Land, called the Railed Pieces, or Stopham Meadow to the said River Arun, at or near a certain Bridge over the same River called Stopham Bridge ... and likewise to make and maintain One other navigable Cut or Canal, from the said River Rother, at or near Stopham Bridge [Recte Shopham Bridge.] called Haslingbourn Bridge, within the said Parish of Petworth'

The main navigation, which was probably completed in 1795, ran from Stopham to Midhurst, 11.3 miles in length with eight locks - Stopham Lock, Fittleworth Lock, Shopham Lock, Coultershaw Lock, Ladymead Lock, Lodsbridge Lock, Moorland Lock, and Todham Lock, giving a total rise of 46 feet [See Of 13/17/18]. The branch to Haslingbourne was 1.3 miles in length with two locks. The main navigation became disused in the 1880's, the last tolls being collected in 1888 but the Haslingbourne branch was closed after only a few years of use, probably in 1826. [See Of 13/41a/35]

The Warrant of abandonment of the navigation was issued by the Ministry of Transport on 15 April 1936, under s.45(1) of the Railway and Canal Traffic Act, 1888 (50 and 51 Victoria c.25), and the order of release from all liability and statutory obligations to maintain the navigation was made by the Ministry of Transport on 7 July 1936, under the same Act
