1 Portmote: 22nd November, 6 Elizabeth [1563]

 

Humphrey Reynoldes of the City of Chester, draper, came into court and shewed a writ of Sciri facias against Thomas Bildon, senior, of the same, tallow-chandler, and Thomas Bildon, junior, of the same, Serjeant at Mace in the City of Chester, in a plea of debt, and sought process against them, which was granted. Order that, since on 26th June, 5 Eliz. [1563], the Bildons had come before the mayor and acknowledged themselves to owe Humphrey Renoldes £6 on condition that 20s. be paid at the feast of St. Michael the Archangel, 20s. at the feast of the nativity of our lord, and 20s. at the feast of the Annunciation of the Blessed Virgin Mary, that the Sheriffs should bring them before the Mayor at the next Portmote Court. Laurence Smyth, kt., Mayor, on the 22nd November, 6 Eliz. gave day for the plea. On the 6th December, Humphrey came and appointed Roger Hale his attorney, and the Sheriffs, Hugh Rogerson and Gilbert Knowles, were ordered to execute the writ against the Bildons. Thomas Bildon senior, did not appear.... and the court granted Humphrey execution against him for the £6 owing as well as 12d. damages and 12d. costs.

 

And the foresaid Thomas Byldon, junior, appeared.. and sought leave to imparl until the next Portmote Court. He repeated these tactics until on 17th April, 7 Eliz. [1565] he claimed he had paid and sought judgement by the writ. Humphrey by his attorney, asked for an inquest by the country and the sheriffs were ordered to make twelve men appear before the next Portmote Court to inquire of the same....
