Of made by (a) Harry Smith (of Grosvenor House, Grosvenor Rd., Coventry), solicitor, firstly, that he is the senior partner in Seymour Smith & Co.; secondly, that on 31st Oct., 1940, he acted for Messrs. Lester & Harris Ltd. (Park St., Foleshill, Coventry) for the purchase of 332 sq. yd. (fronting 46 ft. to Webster St.) with a building used successively as a theatre, billiard room and repository; thirdly, that he has produced the original draft conveyance for that transaction; fourthly, that that conveyance is valid; and fifthly, that the deed has been forwarded to Lester & Harris Ltd.: (b) James Harris (of 52, Kenilworth Rd., Coventry, company director), firstly, that since June, 1920, he has been the company's managing director; secondly, that from 2nd Nov., 1940 the deeds had been kept at the Webster St. premises; thirdly, that the deeds were destroyed by bombing on 9th Apr., 1941; fourthly, that the premises are not charged or encumbered; and fifthly, that the company has enjoyed relevant rents and profits since the 1940 deed was made. |
