Assignment of a Lease (for 2000 years)

 

1. Mary Richards of Grosvenor Square, Middlesex, widow of and executrix of John Richards of Longbredy, clerk, dec'd.

 

2. William Drewe of New Inn, Middlesex, gentleman.

 

3. Charles Best formerly of the City of London, merchant, since of Worcester, but now of Bath, esquire.

 

4. Richard Fowler of New Sarum [Salisbury], Wiltshire, Doctor Physik.

 

5. The Hon. James Edward Harris, known as Viscount Fitzhams of Spring Gardens, Westminster, Lord of the Treasury.

Recites a. Conveyance (Release)

 

(1) John White esquire, and Grace his wife, and Catherine Cary, spinster.

 

(2) Charles Best and Henrietta Harriotta his wife, and George Stratton esquire, and Hester Eleanor his wife.

 

(3) Bennet Combe esquire.

 

(4) Richard Moses Yeldham esquire (trustee of (2)).

 

(5) William Drewe (trustee of (2))

 

Manor and hereditaments below described.

 

Property to the use of Charles Best alone so as to prevent his wife being dowable thereon.

 

b. Mortgage (Demise for 2000 years)

 

(1) Charles Best aforesaid.

 

(2) Richard Moses Yeldham then of Broad Street, City of London, but now at Madras in the East Indies, esquire

 

(3) John Richards aforesaid

 

Manor and hereditaments below described

 

(1) to (3) by nomination of (2), but to revert to (1) should he pay £1300 with interest, or within 6 months of his decease by his executors.

 

c. 3 and his wife Henrietta Harriotta can appoint new trustees in the event of either death of R.M. Yeldham or W. Drewe.

 

d. John Richards made his last will on 29 October 1802, and made his wife sole executrix. He died 1 October 1803. His will was proved in the P.C.C. 11 February 1804.

 

e. 4 has agreed to purchase the premises below mentioned, free from mortgage debt, from 3 for £13,500.

 

f. It was agreed that £1,300 of the above purchase sum should be invested in 3% consols in the joint names of R.M. Yeldham and W. Drewe, trustees.

 

g. R.M. Yeldham is now resident in Madras, East Indies.

 

h. an official discharge of the £1,300 cannot be made due to R.M.Yeldham's absence.

 

i. 4 has paid the £1,300 to W. Drewe who has invested the sum in the purchase of £2,015 10s. 1d. consols in the joint names of R.M. Yeldham and R. Drewe.

 

j. Conveyance (Lease and Release)

 

(1) Charles Best.

 

(2) Richard Fowler.

 

(3) Edward Hinxman of Durnford Wiltshire.

 

Manor and hereditaments below described.

 

(1) to (2) above property.

 

Consideration: £1,300 paid by (2) to W. Drewe £12,200 paid by (2) to (1) as residue of purchase money.

 

k. It was agreed to assign above premises to 5.

 

1 to 5 below property

 

Manor of Baglake otherwise West Baglake, and meadow called Nappers mead comprising 2½ acres in Longbredy, formerly part of the manor of Baglake, and also cottage and garden called Rowden, and ground called Weatherleaze and Newtons Close comprising 18 acres in Litton [Cheney].

 

Consideration: 10s.

 

Consols are now in the name of W. Drewe and R. M. Yeldham and the manor has been released from that debt. 5 Apr. 1811

 

Release from trust

 

1. Charles Best of Douglas in the Isle of Mann esquire (one of the 3 children of Charles Best dec'd and Henrietta Harriotta, one of the daughters and 2 surviving children of William Light, esquire, dec'd).

 

2. Rev. James Wilkes Best of Chieveley, Berkshire, clerk (one of the other children of Charles Best dec'd)

 

3. Catherine Best of Bath spinster (remaining child of Charles Best dec'd)

 

4. William Drewe surviving trustee under Charles and Henrietta H. Best's marriage settlement.

 

Recites a. Document drawn up by William Drewe and Charles Best dec'd, on 15 February 1813, which recites that another document of the same date made between

 

(1) Richard Moses Yeldham

 

(2) William Drewe

 

(3) Charles Best and Henrietta Harriotta his wife

 

(4) Rev. Philip Wroughton

 

Was about to be sent out to the East Indies for execution by (1).

 

b. Richard Moses Yeldham relinquished his trusts and powers through the above document given to him by deed

 

8 February 1793.

 

c. Charles Best and Henrietta Harriotta his wife nominated Philip Wroughton to be trustee instead of R.M. Yeldham, with 4.

 

d. CB and HHB directed that the 3% consols totalling £2,015 10s.1d. should be put into the new names of P.W. and W.D.

 

e. PW and WD released Richard Fowler, Charles Best and Mary Richards and all others concerned of the sum of £1,300.

 

f. PW died 6 June 1812.

 

g. There were three children of Charles Best and Henrietta Harriotta his wife dec'd namely 1, 2, and 3.

 

h. No joint appointment was made by Charles Best and Henrietta Harriotta of the sum of £1,300 or £2,015 10s.1d. it being reserved to Charles Best alone by deed of 28 May 1813.

 

i. Charles Best died 28 May 1813.

 

j. Henrietta Harriotta Best died 5 May 1816.

 

k. At the special request of 1, 2, and 3 the said sum of £2,015 10s.1d. of 3% consols is to be converted into money, and to be divided into 3 equal shares.

 

1, 2 and 3 agree that the sums are correct and release 4 from his post as trustee.
