Case of Mr. Mallock with Opinion of John Darnall, Nicholas Hooper and John Pratt.

 

Recital of Will of Roger Mallock conveying lands in Cockington to Trustees in trust for his son Rawlin and his heirs male and after his decease without issue, to the son or sons of the Testator, etc. Rawlin Mallock levied a fine to the use of himself for life, the remainder to Rose his wife for life and then to his heirs. In Marriage Settlement with Elizabeth Collins, he conveyed the same to the Trustees to the use of himself, the remainder of part of the premises to his wife for her jointure and the remainder of the whole premises to the first son of his body or of the body of his intended wife in tail male. Notes that Rawlin Mallocke has had issue by Elizabeth Collins - Rawlin, who is dead without issue, and by his former wife - one daughter Rose who is still living. Roger Mallocke the goldsmith is dead and Rawlin his son is now in the possession of the premises.

 

Question - if the remainders limited by the Will of Roger Mallocke are well docked and the lands and premises well conveyed to Rawlin Mallocke, the present possessor.

 

All three are of the Opinion that they are.
