Consideration: rents and covenants

 

Counterpart demise of a messuage and closes in the townships of Hankelow and Newhall (now or late Samuel Shaw, as tenant to Boughey), reserving to the lessor timber, minerals, and sporting rights, with liberty to cut timber, sink pits etc; from 25 March last for a term of 21 years. Rent for the first year until Boughey begins to erect a more suitable dwellinghouse for the better managing the dairy arising from the produce of the premises, £200 clear of land tax and other taxes parliamentary or parochial, payable at Michaelmas and Ladyday, the first payment due now as a forehand rent; after the first year, £210; with £10 for every acre of meadow converted into tillage and £5 for every acre of land continued in tillage above 3 years. Proviso for immediate distraint for rent and for sale of the distress after 6 days; reentry after 20 days if no distress found.

 

At the end of 7 or 14 years, Boughey may determine the lease on 6 month's notice; the tenant may do likewise. Covenantsby the tenant for payment of rent and penalties, payment of all taxes, maintenance of the premises, use of all muck etc on the place. The tenant covenants not to take more than 3 crops off any piece of land. He will draw at his own charges all bricks, lime, tiles, and timber needed for building the intended dwellinghouse or other buildings, or in the making of any road on the tenement for the better occupation of the premises. He will keep 2 dogs sent by Boughey or his heirs and assigns, and do his best to preserve trees and hedges, and not stock or crop any timber, nor kill or destroy game and fish but preserve them to the utmost of his power. Covenants as to husbandry at the end of the term.
