Reciting: this deed is supplemental to a settlement: 1905, Oct. 30

 

1. James Whitaker.

 

2. Mary Isabella Sophia Louisa Whitaker (therein described as Hon. Mary I. S. L. Weld Forester).

 

3. Rt. Hon. Cecil Theodore Weld, Lord Forester.

 

4. Hon. Francis Henry Cecil Weld Forester and Arthur Eustace Seymour Guiness.

 

Settlement in consideration of impending marriage of 1 and 2 agreeing that a 1/5 share of a sum of £15,000 receivable on the death of 3 and the investments representing the same should be held on trust to pay the income to 2 during her life and then to 1 for his life, then to all or some of their children or remoter issue, the children to take vested interests within 21 years of the death of the survivor of the marriage in shares at times and ages as 1 and 2 should appoint; further agreed that all real and personal property not settled to which 2 should become entitled should be conveyed to the trustees of the settlement subject to the same powers and provisions.

 

The issue of the marriage is Claire Isabel Churchward who has attained 21 years and 5 March 1935 married Paul Rycaut de Shordiche Churchward.

 

Appointment that the Trustees shall after the death of the survivor of the appointors and in the meantime subject to their life interests stand possessed of the trust premises and any other property which becomes subject to the principal deed as to one moiety in trust for Claire Isabel Churchward and as to the other moiety on trusts hereinafter declared concerning the same. The Trustees shall stand possessed of the latter moiety on trusts to pay the income to C., I. Churchward for life and 1 to hold the capital and income in trust for those child or children of C. I. Churchward other than one that shall inherit the Winsley estate of Jas. Whitaker that shall attain 21 in equal shares.

 

Provided always that no child of C. I. Churchward shall take a share of the moiety unless he/she shall have attained the age of 21 years within 21 years of the death of the survivor of the Appointors and that should there be only one child of C. I. Churchward having attained the age of 21 the moiety shall be held in trust notwithstanding that he/she may inherit the Winsley estate.
