1. John Hale of the Hollyes in the parish of Enfield gentleman and Mary his wife, only daughter of John Gough late of Asthall in the parish of Stockton co Salop tanner deceased

Consideration: a marriage already had between John Hale and his wife, and a considerable portion of £1400 received by Hale in marriage, to provide her with a competent jointure and to settle the estate Release to Milles and Maidston of a capital messuage and farm called the Moor Hall in Kinlett; 2 messuages in Alveley (Charles Hawkes and Charles Ley) a parcel arable called Henfield (15a), 2 coppices and meadow ground called (blank) (10a), 2 pieces arable or pasture adjoining the coppices (12a), 2 closes arable or pasture called the Stone Pitt leasows (12a), 1 close arable or pasture called the Two Tree Leasow (10a), a close arable or pasture called the Well leasow (7a), 5 closes called Duddells (32a) 3 meadows called White's meadow, Gravenor's meadow, and Mott meadow (18a) with a cottage standing on White's meadow, 3 leasows called the Two Oxe leasows and Brickhill leasow (16a), 2 closes called Swinford (12a), 2 closes called Sallicox (15a), all in Alveley, Astley, Nordley Regis, and the parish of Alveley (John Hale), to create tenants for a recovery to enure to use of John Hale for life, after to use of Wollaston and Ryder and their heirs during Hale's life upon trust to preserve, after, as to the capital messuage called Moorhall and land in Kinlett and the 2 messuages and lands in Alveley (Hawkes and Ley) and land called Sillicox, White's meadow, Gravenor's meadow and Mott meadow, Swinford, Oxe leasows and Brickhill, the cottage on White's meadow, and the Well leasow, to use of Mary, now wife of John Hale, for life as jointure, after Wollaston and Ryder upon trust to preserve, after to use of Henry Wollaston and Edward Hale for term of 500 years on trust, subject to this to use of sons in succession and heirs male of their bodies, in default the right heirs of John Hale; as to the residue of the property, to use of Hale for life, Wollaston and Ryder to preserve, after to use of Wollaston and Hale for a term of 500 years, on trust, after to use of sons in succession and heirs of their bodies, remainder to the right heirs of John Hale.

 

The terms of 500 years are limited on trust in case John Hale and Mary leave daughters or younger children who live to the age of 21, to provide portions, if one, then £1000, if more, then the £1000 divided among them in such shares as John Hale by will or deed shall appoint, or equally at age 21 or day of marriage, the trustees to have power to raise the £1000 if it is not paid, and in case of the death of John Hale, they may raise maintenance for such daughters or younger children (£20 p.a. if one, in more then £40 to be shared among them). If the person entitled to the estate pay the portions, the term shall be void, or if all the younger children or daughters die before the age of 21 or marriage. If Hale and his wife have no daughters or younger children or none surviving, and if the trustees have raised any sum for portions, this shall be repaid to the person to whom the immediate estate belongs

 

Hale releases to Milles and Maidston a capital messuage called the Hollyes (John Hale) with 3 orchards, gardens, barns etc, a close arable called Lower field and meadow adjoining (15a), 2 closes arable called Overfield and Deanfield near the Hollyes (John Hale), to hold to use of Hale for life, after Wollaston and Ryder in trust to preserve, after to use of sons in succession and heirs of their bodies or the right heirs of John Hale Warranty

 

Hale covenants that the property settled as Mary's jointure is of the full yearly value of £90 and shall so continue during her life, and in case they at any time fall short, then John Hale his heirs executors or administrators shall make up the same to £90 out of other lands
