Description:

Upon a petition this day exhibited unto the Lord Keeper, showing that whereby an order of the 13th November last it was order upon hearing of the cause that the plaintiff should attend the defendant, Sir John Oglander some time in the last vacation and should deliver to the defendant all the notes and accounts formerly delivered unto him by the deft. to the end that the deft. might make him satisfaction if there were any mistaking or double charging and in the meantime the dismission of the cause to be stayde and that accordingly the plaintiff of the last term tendered unto the defendant the said notes and accounts in presence of divers gentlemen and desired him to regulate the differences between them, which he refused to do - the plaintiff prays that the signing of the said dismission must be stayed until the matter may be moved into court.
