Description:

Release forming a conveyance between Edward Baber of Park Street in the parish of St. George, Hanover Square, Middx., esquire (i), the Right Honourable Charles Henry, 5th Earl of Peterborough and Monmouth (ii), and Thomas Garratt, citizen and grocer of London (iii).

 

Recitals:

 

(I) Indentures of Lease and Release dated 17 and 18 Jul 1783 forming a conveyance from (ii) to (i) by way of mortgage, to secure £17000, of the Manor of Turvey and all those messuages, cottage, tenements and farms with their appurtenances in Turvey, containing 3396a. with rents amounting to £1600 p.a.

 

(II) (iii) agreed with (ii) for the absolute purchase in fee simple of and in the lands to be conveyed for £6000.

 

(III) (ii) owes (i) the principal sum of £17000 and interest on the recited security and premises; part of the sum, £11750, is to be paid (by the direction of (ii)) to (i) by Charles Higgins esq. (the purchaser of the other part of the premises aforesaid) and agreed between (ii) and (iii) that the sum of £5250, the residue outstanding, shall be paid off and discharged by (iii) out of the sum of £6000 consideration for the lands to be conveyed.

 

Operative part:

 

In consideration of £5250 paid (by the direction of (ii)) to (i) by (iii), making together with the sum of £11750 to be paid by Charles Higgins to the whole sum of £17000 in full discharge of the principal money owing to (i), and also in consideration of £750 paid by (iii) to (ii), which together with £5250 amount to the full purchase price of £6000, for the complete purchase in fee simple of the lands as described, (ii) conveys to (iii):

 

(a) Turvey Farm, now in the occupation of Hugh Row, comprising:

 

- all that messuage or farmhouse with the appurtenances (6a. 2r. 36p.)

 

- all that other messuage or farmhouse with the homestead of old inclosed land with the appurtenances (5a. 2r. 19p.)

 

- and also all that piece of old inclosed land with the appurtenances (12a. 3r. 23p.), commonly called Costern Gill.

 

- and also all that other close of old inclosed land with the appurtenances (3a. 1r. 14p.) commonly called Coblers.

 

- also all that other close of new inclosed land with the appurtenances (18a. 1p.) commonly called Goblin's Hole.

 

- also all that other close of new inclosed land

 

- with the appurtenances commonly called Windmill Hill.

 

- and also all that other close of old inclosed land with the appurtenances commonly called Little Lithernail.

 

- and also all that other close of old inclosed land with the appurtenances (5a. 7p.) commonly called Markhams Close.

 

- and also all that piece of old inclosed woodland with the appurtenances (2a. 1r. 35p.) commonly called Martins Coppice.

 

- and also all that other close of old inclosed land with the appurtenances (19a. 1r. 26p.) commonly called Rows.

 

- and also all that other close of old inclosed land with the land and appurtenances (6a. 1p.) commonly called Pixhill Close and Lane.

 

- and also all that other close of old inclosed land with the appurtenances (2a. 2p.) commonly called Two Acres.

 

- and also all that other close of old inclosed land (3a. 1r. 4p.) commonly called Dovehouse Close.

 

- and also all that other close of new inclosed land

 

- with the appurtenances (21a. 3r. 17p.) commonly called Middle Hill.

 

- and also all those two other closes of old inclosed land with the appurtenances (containing together 2a. 3r. 23p.) commonly called House Close, Rye Close, Pye Close and Middle Pitt Green.

 

- and also all that other close of old inclosed land with the appurtenances (13a. 2r. 35p.) commonly called Harrison's Great Close.

 

- and also all that other close of old inclosed land with the appurtenances (6a. 1r. 15p.) commonly called Harrisons Close.

 

- and also all that other close of old inclosed land with the appurtenances (13a. 10p.) commonly called Harrisons Close.

 

- and also all that other close of old inclosed land with the appurtenances (16a. 2r. 33p.) commonly called Carter's Little Field.

 

- also all that other close of new inclosed land with the appurtenances (5a. 3r. 4p.) commonly called Thirteen Lands.

 

- and also all that other close of old inclosed land with the appurtenances (3a. 1r. 15p.) commonly called Three Acres.

 

- and also all that other close of old inclosed land with the appurtenances (4a. 2r. 39p.) commonly called Five Acres.

 

- and also all that other close of old inclosed land with the appurtenances (10a. 1r. 25p.) commonly called Bankey Close.

 

- and also all that other close of new inclosed land with the appurtenances (27a 1p.) commonly called Turvey Piece.

 

(b) Bayden Farm, Turvey, now in the occupation of William Stevington, comprising:

 

- also a piece of land in Steventon (1r.) and commonly called the Lower Field.

 

- and also all that other tenement or farmhouse with a pightle homestead of old inclosed land (3a. 14p.)

 

- and also all those two other closes of new inclosed land (54a. 1r. 26p.) called Ashtree Close and Beanhill.

 

- and also all other close of new inclosed land (27a. 3r. 22p.) commonly called Whitelands.

 

- and also all that other close of new inclosed land with the appurtenances (39a. 1r. 32p.) commonly called Dogtail Close.

 

- and also all that other close of new inclosed land with the appurtenances (7a. 1r.) commonly called Bayden.

 

- and also all those other several closes with the appurtenances (containing together 39a. 22p.) commonly called Bayden Closes.

 

(c) Abbey Farm, Turvey, now in the occupation of Lavender Fowler, comprising:

 

- all those closes of old inclosed land with the appurtenances (3a. 3r.) commonly called Butchers and Tolls Closes.

 

- and also all that other close of new inclosed land (21a. 1r. 5p.) commonly called Chalsoe.

 

- and also all that other close of new inclosed land with the appurtenances (26a. 3r. 26p.) commonly called Pothooks.

 

- And also all that other close of old inclosed land (6a.) commonly called Townsend Close.

 

- And also all that close of new inclosed land with the appurtenances (24a. 26p.) being the other half the recited Turvey Piece.

 

(d) Cottages in Turvey, in the occupation of the following tenants:

 

John Peers, John Wooding, John Young, John Howlett, John Serjeant, John Robinson, William King, David Loddington, William Falkener.

 

Habendum: to the only use and behoof of (iii), his heirs and assigns forever.
