William Abbott - and which by the Inclosure Award for Swerford were not allotted unto any person other than Ferdinando Tracy Travell and also all and singular the lands etc. which by the said award were allotted to the said Ferdinando Tracy Travell in lieu of yard lands commons and other interests affected by the lease and release 1 and 2 April 1751

Recites lease and release of 1 and 2 April 1751 and a common recovery of Easter Term 24 George II wherein the premises were conveyed to certain uses and in the Release is contained a power enabling said John Travell the son and Francis Travell to revoke the uses and to create new uses

Recites Indenture of 15 Sept. 1752 in which the said John Travell and Francis Travell revoked the uses and did appoint that the said Recovery should enure to the use of Edward Crewe for securing £1,200 lent by Edward Crewe to John Travell and Francis Travell, together with interest and after repayment to the use of John Travell and Francis Travell their heirs and assigns for ever

Recites Lease and Release of 15 and 16 Sept. 1752 in which, in consideration of the £1,200, the premises were released to Edward Crewe his heirs and assigns for ever subject to proviso for making void on payment of the said £1,200 and interest.

Recites Lease and Release of 17 and 18 April 1758 which recited that the £1,200 was not paid and that it was the proper money of Edward Ryves and in consideration of £1,200 paid to Edward Ryves by George Tompson Edward Crewe, with the consent of Edward Ryves, assigned the premises to George Tompson his heirs and assigns for ever

Recites Lease and Release of 9 and 10 May 1760 in which that part of the premises as were within Hooknorton were assured by George Tompson John Travell and Francis Travell to Sarah Daniel her heirs and assigns by way of mortgage to secure £460.2.6d.

Recites d. of George Tompson and his will in which he devised the residue of his real and personal estate to his wife Susanna Tompson

Recites d. of Susanna Tompson and in her will she had appointed said William Kerr and George Tompson (party hereto) her executors but she did not make any disposition of her real estate and William Kerr and George Tompson proved her will and at the time of her d. Charles Tompson then residing in the East Indies was her eldest son and heir at law and she has since d. intestate and without issue leaving Elizabeth the wife of Samuel Tilley and Mary Tompson his sisters and coheiresses at law and also coheiresses at law of the said Susanna Tompson

Recites d. of John Travell the son in 1762 leaving Francis Travell his eldest son and Ferdinando Tracy Travell his 2nd son

Recites will of Francis Travell but he did not make any disposition of his real estate and d. 1802 unmarried and without issue leaving Ferdinando Travy Travell his only bro. and heir at law who became entitled to the said mortgaged premises (copy will, Flick/I/i/5)

Recites Inclosure of Swerford of 1803 whereby lands were awarded to Ferdinando Tracy Travell in lieu of the lands and grounds directed by the inclosure act to be divided and inclosed

Recites will of Ferdinando Travy Travell in which he devised all his messuages etc. (except his reversionary estate and interest in an estate at Chipping Norton) to John Dolphin John West and Ann Travell upon trust with the consent of the testators dau. Martha the wife of Rev. William Morgan Whalley if she should think fit but not otherwise and after her d. then of the proper authority of the said trustees to sell the said estates.

Recites codicil to will of said Ferdinando Tracy Travell in which he appointed William Horne an additional trustee.

Recites d. of Ferdinando Tracy Travell on 27 Sept. 1808

Recites that all interest on the £1,200 has been paid to the d. of Ferdinando Tracy Travell but that the £1,200 is still owing to 2. as executors and personal reps. of Susanna Tompson who was the sole executrix and residuary devisee of George Tompson together with an arrear of interest from the d. of Ferdinando Tracy Travell

In consideration of £1,562.1s. paid to 2. by 3. for all principal and interest and of 5/- paid to 1. by 3. 1. with the consent of 2. grant the premises to 3. (except the premises in Hooknorton) to hold to 3. to the use of 3. theirs heirs and assigns for ever discharged from the said sum of £1,200 and all interest but upon the trusts in the will of Ferdinando Tracy Travell.

Covenant by 1a. to levy a fine - such fine to be to the use of 3. their heirs and assigns for ever upon the trusts in the will of Ferdinando Tracy Travell.

CONSIDERATION: £1,562.1s. paid to 2. and 5/- paid to 1. by 3.
