Ten part indenture between Edward Harries of Cruckton esq. 1st part, Edward Jeffreys of Shrewsbury gent. 2nd part, Mary Adney of Shrewsbury widow 3rd part, Thomas Harries of Cruckmeole 4th part, Elizabeth, Barbara and Susanna Sandford of Shrewsbury spinsters and daughters of Humphrey Sandford 5th part, Folliot Sandford of the Isle,John Minor of Woodstyle, 7th part, William Minor of Longford farmer 8th part, Walter Minor of Hopely parish of Hodnet, farmer, 9th part, and John Kilvert of Grinshill gent. 10th part.

 

Whereas by an indenture of release of 5 parts, Jan. 29th 1745 ( 465/ ). Marriage settlement of Humphrey Sandford and Elizabeth Jones. Whereas Humphrey Sandford the elder by his will made and executed in the presence of three credible witnesses, June 14th 1788, (see 465/ ), and reciting the indentures of lease and release of Nov. 22nd, 23rd 1770 (see 465/617, 465/618). Whereas by indenture of March 25th 1790 between Thomas Harries, Francis Walker being then dead, 1st part, H. Sandford the elder 2nd part, Frances Sandford 3rd part, and Mary Adney widow 4th part.; Reciting the indentures of lease and release of 22nd and 23rd Nov. 1170 and particularly of the term of 400 yrs limited by the same indenture to Francis Walker and Thomas Harries, and also reciting that Humphrey Sandford and Elizabeth his wife had 6 younger children, Edward, Elizabeth,Frances, Barbara, Susannah and Charlotte, and that marriage was intended between the Rev. Holland and Frances and that Humphrey having occasion for £400 towards her portion had borrowed the same from Mary Adney and had agreed that the premises so mentioned should be a security for the repayment with interest. Assignment by Thomas Harries to Mary Adney, in consideration of £400 paid by her to Frances Sandford, of all the manors, land comprised in the term of 400 yrs. created by the indenture of release of Nov. 30th 1770. To hold by Mary Adney for term of 400 yrs, subject to a proviso of redemption by Humphrey Sandford or the person who after his decease is entitled to the freehold of the premises, on payment of £400 and interest. Whereas sum of £400 received by Frances Sandford was paid to her as her share in the £2000 intended as portions. Whereas H.S. the elder and Elizabeth Sandford are both dead leaving their daughters Elizabeth, Barbara, Charlotte and Susannah Sandford and Frances Holland living all of whom have attained the age of 21 yrs.

 

Whereas they have applied to Folliot Sandford to pay their shares of £2000 and Mary Adney has requested the return of her £400, and Sir John Minor at the request of Folliot Sandford has agreed to lend £1,600 to discharge the shares of Elizabeth, Barbara, Susannah and Charlotte, and doubts have arisen whether the shares ought to be raised by an assignment of the term of 1000 yrs created by the will of H.S. or by an assignment of 400 yrs created by the recited release of 1745. Decided that Mary Adney and Thomas Harries to transfer their estates and interests in the premises; Whereas Charlotte Sandford is at present incapable of giving a legal discharge for her portion of the £2000 share it is agreed that the messuages etc. in Edgton intended for the provision of the share of Charlotte Sandford, shall be reserved for the purpose.

 

In consideration of £400 paid by John Minor to Mary Adney, and £400 paid to Barbara, Elizabeth, Susannah Sandford at the direction of Edward Harries, Edward Jeffreys, and Folliot Sandford, making £1600 in all, release to John Minor of all the manor of Edgton, and premises in Edgton, Brunslow, Woolston and Up Rossall, subject to the payment of £2000 limited to T. Harries and his heirs the will of Humphrey Sandford to raise the same. (except the premises in Edgton now in the tenure of Thomas Rubathan).To hold by John Minor for the residue of the term of 1000 yrs created by H.S's will, subject to the proviso of redemption. Further that in consideration of 10s paid by William Minor to Edward Jeffreys, that he at the direction of Mary Adney, Elizabeth, Barbara and Susannah Sandford and Folliot Sandford assignment of all premises comprised in the indenture of 1745 (except the premises in Edgton); To hold by William Minor for the residue of 400 yrs, in trust for John Minor, subject to the proviso of redemption; further that in consideration of 5s paid by Walter Minor to Mary Adney, at the direction of Folliot Sandford, assignment to Walter Minor of the manor of Edgton and all premises in Edgton, Brunslow, Woolston and Up Rossall, as comprized in the 400 yrs term. and limited to Mary Adney by indenture of March 25th 1790. (except the messuage in Edgton) To hold by Walter Minor for the residue of the 400 yrs, subject to a proviso of redemption

 

Further that for the more effectual securing the £1600 to John Minor and in consideration of 5s paid to Thomas Harries by John Kilvert, assignment by Thomas Harries of the premises compromised in the term of 400 yrs to hold by John Kilvert for the residue of the term in trust for John Minor, subject to the proviso of redemption; provided, it is agreed that if Folliot Sandford shall pay to John Minor or his heirs £1600 and interest, that John, William and Walter Minor and John Kilvert will transfer the manors etc. to the person entitled to the immediate freehold, for the residue of the term of 1000 yrs, and 400 yrs, free from all incumbrances committed by John Minor, Walter Minor and John Kilvert. Covenant by Thomas Harries and Edward Jeffreys that they have not done any thing to prevent the premises being assigned, similarly Edward Jeffreys and Mary Adney Agreed between the parties that nothing in this agreement shall extend in any respects beyond the indentures of lease and release of 22nd and 23rd March.

Docketed. The money advanced by Minor was only £1200, the remainder was Folliot Sandford's, Feb. 4th 1795. Mr Sandford has a declaration in trust from Mr Minor for £400. Feb. 9th 1795. Engrossed on one 20s skin and 4, 17d ones. Joseph Hills.
