(a) Henry Marshall, as in Add Mss 5418, (b) John Henry Marshall, as in Add Mss 5418, (c) Jasper Cowell, as in Add Mss 5418 and w. Alice, (d) Ella Elizabeth Gibbs of Bognor (w. of Harris Hornsby Gibbs of Bognor, builder), (e) said Harris Hornsby Gibbs

 

I. Property, as in Add Mss 5407 (but the adjoining property on E. now described as the property in II below, the adjoining property on S. now described as belonging to Daniel Parsons, and the adjoining property on W. now described as belonging to (e) and known as Ye Olde Cottage), together with the messuage now erected thereon and called Sefton Villa

 

II. Property, as in Add Mss 5412 (but now described as situate on S. side of Lyon Street, having a frontage thereto towards N. of 40 feet, and bounded on W. by the property in I above, on S. by land belonging to George Herbert, and on E. by land belonging to Mrs. Gertrude Smith, together with the brick wall built partly upon the eastern boundary thereof and partly upon the land adjoining thereto, and being a party wall)

 

Conveyance, in consideration of the agreement in (iii) below, from said Alice Cowell, as trustee, with the concurrence of said Jasper Cowell, and from said Jasper Cowell, of their interest in the property in I above, to (d); and conveyance for £160, in accordance with the power in (vi) below, of the property in II from (a), as beneficial owner as to two eighth parts, from (a) and (b) as trustees, with the assent of said Alice Cowell as to five eighth parts, and from said Alice Cowell and (a), as trustees, as to one eighth part, to (e), but subject to the lease as in Add Mss 5412, (which is vested in the purchaser)

 

Recites: (i) Add Mss 5418; (ii) that doubts have arisen as to conveyance of one eighth part of the property in I, as said Jasper Cowell was not a party thereto, nor has the deed been acknowledged by said Alice Cowell; (iii) that to remove all doubts (c) have agreed to execute this deed to convey the one eighth part to (d); (iv) Add Mss 5412; (v) that the estate of which Thomas Charles Marshall was formerly seized in the property in II is now vested in (a); (vi) that (e), in pursuance of the power in Add Mss 5412, has given (a), (b) and said Alice Cowell notice of his wish to purchase the freehold of the property in II above; (vii) that (e) has paid all rent due upon the property in II above

 

Acknowledgment by (a) of the right of (e) to the production of deeds 1863-1883, listed in a schedule; and by (a) and (b) to deeds of 1885, 1888, listed in another schedule
