property which was AGM's share of the estate of the late John Elger, in exchange for the purchase of an annuity of £200 per annum for REM from the Law Life Assurance Society

 

a) freehold property: houses at 40 and 58 Rutland Gate, St Margaret Westminster, Middlesex; stables and premises with living rooms above at 6 and 12 Rutland Mews South, St Mary Abbotts, Kensington

 

b) investments: £900 mortgage of River Plate 4.5% debenture stock; £1000 Merchant's Trust 4.5% debenture stock; £1000 MonteVideo Water Works First debenture stock; £304 . 9s Quensland 3.5% stock; £500 Victoria 3.5% inscribed stock; and £250 Ind Coope & Company's "B" debenture stock

 

Recites will of JE dated 12 November 1879 in which he appointed wife CE, JE and TGEE executors and Trustees, and in which the residue was to be sold by the Trustees and the profits put in Trust for all his male grandchildren who had attained 21 years and all female grandchildren who had attained 21 years or married with consent, and their children

 

Recites JE died 12 August 1888, his will proved at the Principal Probate Registry 17 September 1888

 

Recites CE died in his lifetime, and at the time of JE's death he had 6 grandchildren - John Elger, Edward Gwyn Elger, Ronald Haydon Elger and Leonard Gwyn Elger, all having attained 25 years, and Eveline Mary Elger and Agnes Gwyn Elger

 

Recites indenture 22 March 1890 between 1) JE and TGEE, 2) Sarah Elizabeth Elger, 3) Eveline Mary Elger, 4) Edward Gwyn Elger, 5) Agnes Gwyn Elger, 6) Ronald Haydon Elger, and 7) Leonard Gwyn Elger

 

JE and TGEE set apart the real property a) with £2222 cash on account of AGE's share

 

Recites AGE married REM on 6 August 1891, having attained 25 years

 

Recites the will of Agnes Gwyn Macdonald dated 7 March 1899, by which the Trustees were to pay REM out of her estate £200 per annum or one third of the value of her estate, whichever is the less

 

Recites AGM died 23 August 1905 without issue, her will proved at the Principal Probate Registry 11 December 1905

 

Recites parties in 2) 3) and 4) agree with 1) that the £200 appointed by AGM for REM should be used to buy an annuity
